Hi everyone I have just started a claim against capitol one, i'm at the stage were I have sent the Preliminary approach for repayment letter and a schedule of charges sheet(i did not add the interest at this stage I hope that that's the correct way).

I have recieved a response in which capitol one acknowledge my claim but they tell me that it will take 4 weeks to look into my claim and if it takes longer than 4 weeks they will write to let me know.

Is this what should happen at this stage or are they just delaying.

The 20th of july is the 2 week limit, should i move onto the LBA letter or just wait for them to get in touch.

My charges come to 326 pounds without interest..

Any advice from anyone at the mo would be much appreciated....

Thanks..

Hi,

I'd send the LBA after the 20th, what sort of interest are you going to ask for ?

Regards.

Scott.

No, I've sent them the "Failure to respond to a CCA request" letter putting the account into dispute. This "four weeks to respond" tactic seems to be cropping up all over the Cap 1 thread and seems to be a standard letter when they don't quite know what to do.

Why send a letter saying it will take four weeks when the statutory limit is 12 + 2 days?..totally beyond me...

I know what you mean.

I stopped paying my monthly payment(which was a measly minimum 9.00) when i started the claim, i have had none stop phone calls and mobile calls and txt's, there doin my head in... I have only missed one payment so far, surely that 9.00 isn't going to make much difference....

"It's going to take us a little while to look into your situation and come back with a detailed response. We'll do everything we can to get an answer to you within 4 weeks of this letter.

If for someour investigations take longer than 4 weeks, we'll contact you to tell you why this is.."

It's your claim, it's your deadlines.

Technically you need to give them 14 days after the initial letter asking for your charges back. Then you should send a LBA giving them another 14 days.

At that point you then make the decision, immediate application to the Court or wait for them to reply. This way you have been seen to be acting reasonable.

pers i think your firing the court gun too soon.

you need to go through the fos if they have given you their final response or have taken more than 8 weeks to address your complaint.

Hi all, well quick update.

Rec'd letter from cap one on friday stating that there charges have been correctly applied to my account, they believe there charges to be fair and lawful( yeh believe what you want cap one:p).

I'm now ready to file a Claim at MCOL on wednesday.

Hope this is the right way to go, i'm also going to add the 8% interset too.

Hi, been away for a couple of days so going to start MCOL tomorrow, got a few questions though.

I've been reading up on the POC;s and find it confusing..

How do the court know that it's a credit card and not a bank account, do i put this in the POC.

What happens if they still don't pay up..

Any advice would be much appreciated......
