I have had a read of your thread.

 

Why don't you put in a plea of 'no legal title to sue', regarding the legal assignment issue.

 

The authority on assignment:

 

Roberts (FC) (Appellant) v Gill & Co Solicitors and others (Respondents) -

[2010] UKSC 22.

 

Have a very good read of that, Judgment given on 19 May 2010, Heard on the 22 and 23 February 2010.

 

You will find info on case law there for you to refer to and rely on as far as assignment is concerned.

Did you manage to find W F HARRISON -V- BURKE AND ANOTHER ???

 

i too am looking for this case and cannot locate it.
