    • Yes, await the Directions Questionnaire from the court. No, the Directions Questionnaire is just a short form and leads to the case being transferred from MCOL/CCBC to your local court.  If you Google "Form N180" you can see a blank copy on government web pages.
    • There will only be one hearing (typo possibly 25th is a Saturday Courts closed ) clarify with the court.

    • No Andy, I'll scan, redact and upload later today. So the court sent me 2 letters, same envelope and stapled together but with different dates!. 1. N24 General Form of Judgement or Order, stating: UPON considering the papers herein IT IS ORDERED THAT The claim is listed for an attended hearing 25 May....... at which court will consider allocation..  etc   2. N24 Notice of PTR/Adjnd/Restored/Hrg/Management conference TAKE NOTICE that the hearing will take place on 24 May at....... When you should attend 30 minutes has been allowed for the Hearing   No other instructions anywhere in the envelope or on the letters. Do I attend both?
    • Then leave it just proceed with the claim( strike out/SJ application are risky).....the defendant will not be permitted to rely on written evidence (documented) only verbally as they failed to comply with the N157 (unless they have filed with the court and failed to serve you a copy) ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

Just after some opinions please .....

 

My partner has a citi credit card which we paid off (full and final settlement) in March this year and asked to close the account. They have been sending us monthly statements, applying charges and basically been a complete nightmare with the harrassment and refusal to close the account as agreed.

 

Today they finally admitted fault and closed the account (still awaiting for the letter so not holding my breath) and have offered us compensation but no figure. We have been advised to think about it over the weekend and get back to them on monday with an amount.

 

Unfortunately this problem has affected our credit report as they have logged we have missed 6 payments over the last 7 months despite the final settlement payment. This they are going to correct. But I started a new job on monday having handed in my notice and left my old position. Two days into this job which is in a financial environment I was advised that I couldn't keep my job due to the credit check they had run. Naively I didn't think Citi were at fault as they had told us they hadn't logged anything.

 

So tonight I have check both our credit files and the only negative is the issue with Citi. So this problem has cost me my job and my household £300 per month as I now have no job.

 

Citi are aware that they could be the cause of this and certainly changed their attitude when they were told and managed to solve a problem which so far has taken 7 mths in the space of an hour!

 

My question is what do we do? Obviously aside from looking for another job which could take a while given the current climate. What sort of compensation should we be seeking? We have told them if they are the problem on the credit file we will seek loss of my earnings from them (and we will certainly need it).

 

If we calculate the time put it, charges of phone calls, letters and my loss of earnings for a year it comes to about £6700 and 6 months loss of earnings is just over £3000 .... this seems very unlikely to me but their error has cost me my new job and will cause lots of financial difficulty. Really don't know what to do.

 

Any advice from anyone would be greatly received.

Hi Joanneg,

 

Just some initial thoughts but I would seek legal advise about this asap.

 

Under normal circumstances this site would be able to help with dodgey bank charges & PPI but this sounds a lot more serious.

 

A complaint to the FSA explaining what has happened would not hurt either but do get legal advise NOW.
