i started letter tennis with them at the same time as the previous thread jan 09

 

in all 15 letters from me

started fos complaint in nov 09

 

received fos letter july 10 saying they upheld my complaint.

 

now waiting for HFC to cough up

 

i need to investigate if they can off set from this refund [12yrs closed a/c] against arrears on a active A/C

 

anyone know?

what the fos have said:

 

I am pleased to let you know that following our involvement, HFC Bank has now agreed to make an offer to settle your complaint regarding loan account numbers account b and account A.

 

HFC Bank will be writing to you to explain the precise terms of its proposed settlement - however, it has told us that it will be based on the general approach that the Financial Ombudsman Service takes when we decide that a consumer has been mis-sold a PPI policy.

 

When we find that a policy such as yours was mis-sold we usually ask HFC to put you in the position you would have been in if the policy had not been sold.

 

We would expect this to be done by refunding to you the premiums you paid for the policy as well as interest at a rate of 8% simple per year, from the date you paid the premium to the date the settlement is paid.

 

HFC has agreed to calculate and pay compensation in this manner. You should note that the settlement will also take into account whether a claim has been paid under the policy.

 

If you would like to accept this offer, please sign and return the enclosed settlement form to us by 31st August 2010. We will then pass the form to HFC Bank so it can finalise the details of your settlement with you.

 

Please note that by signing the form, you are accepting the general approach to calculating the settlement on your complaint.

HFC Bank will then write to you with the exact figures (and revised loan details where appropriate) once the calculation has been carried out.

 

If, once you receive the figures, you believe that the firm has made an error in the way it has carried out the calculation, please contact the firm initially to discuss this.

 

If you are unable to resolve the matter with the firm, we will be happy to assist you.

I see what you mean about the wording - looks like maybe the FOS are finally getting the message about getting us to sign accepting in 'full and final' when we have no idea what we are agreeing to.................

there is no mention of it being an F&F , leaving the door open for pending secret commission investigations which i am currently compiling.

 

and yes possibly will sign

 

going over with a find toothed comb this week.

acceptance letter was returnd on the 26th august...still awaiting hfc to cough now they have been told to.

 

have had two pers calls from foc.

 

one on the entries to my credit file whilst account a [my first hfc thread a/c] was in dispute over ppi, because i complained they had marked my file during a period of dispute.

'had i had a response on this from hfc yet...no . he'll get them on that.

Your complaint about HFC Bank Limited (HFC Bank)

I wrote to you on 4 November 2010 and explained my reasons for upholding your complaint in relation to the loan numbered 2b

As you agreed with my recommendations in relation to the loan numbered 2b

I have sent your signed acceptance form to HFC Bank.

HFC Bank will be in contact with you shortly regarding the payment of redress in relation to loan 2b.

HFC Bank has informed me that the redress will be paid by BACS.

 

moving fwd slowly..........

hfc will pay out normally within two weeks DX, ime starting my new complaint and claim against them, following the FSA;s published charges regime ,it is fact that HFC have not been adhering to the rule they have been charging or should i say using the American method of calculations which in my case amounts to 10.00 per month more than the FSA figures ,so ten years of overcharging methinks dude ...nice tidy sum huh

why not use the american calculator as do HFC seems they disregard the FSA calculator

got a letter today from HFC

 

they are going to refund £2280.61

almost exactly the figure my spreadsheet calcs

 

i'm really confused about this add 8% on the bal.

 

i've never seen it before

 

my figures are £17.54 payments PCM

then 8% stat int from each date it was levied to today

 

cant see how you get an extra 8% again from when the loan finished to dtoday, as i've already got that by claiming to today on each payment

 

am i totally stupid?

spoke direct to the adj today

 

the calc i have done is correct

 

they use no of days since payment to date of oc's letter stating their offer at 8% simple for ppi claims where the A/C is completed.
