    • Thanks HB. I never evaded fare before.  Should I send any email to ask my case or beg again to show that I indeed know I’m wrong? To be honest, I indeed find that I’m wrong and will never do such thing.
    • We never know how long they will take to respond, it depends on how busy they are. They also look through people's ticket history to see if everything is normal. If you haven't evaded fares before this won't be a problem for you but it takes time. It seems that train companies are doing this more and more. HB
    • just type no need to keep hitting quote there was no reply pack asking questions nor wanting Income & expenditure, so can't be a letter of claim. there are no 'court sanctions' at all should a defendant ignore a letter of claim, total poppy cockle!! very much the reverse, should a claimant NOT send a letter of claim before they raise a court claim, it's a very good browny point for a defendant !! stop worrying....i wish certain members would stop posting unnecessary personal speculation on threads... doesnt help anyone. if you DONT KNOW - DONT POST!! its a 2005 card anyway pre the revisions, sao cant use a recon and i'd expect a CCA request to fail.  this is cabot!! 99% of their debt portfolios are always unenforceable. just the mugs keep being ignorant cash cows is the only way they recently stayed in business.
    • Hi, everyone. It has been 18 days since I sent the begging letter, and I still haven't received a response. I've read some threads and found that OOC settlements are often responded to very quickly. Does this mean it will be difficult for me to receive an OOC settlement?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been ill for nearly 4 months now, its one of the reasons I haven't been on here much.

 

My GP is at a loss, just kept saying give it time, then give it a little more time. 3 months in she finally referred me to a general medical specialist at the hosptial, it was about a month wait and I was supposed to see them on Monday coming. I have it all confirmed in writing etc.

 

Then a letter today saying the appointment has been cancelled and the next availible appointment is 4th October. Needless to say I am absolutely livid. I dont understand how this can happen.

 

Is there anything I can do, are they in breach of any duty of care?

 

I'm probably going to try and get a private GP appointment and get a referral to the specialist that way. Its money I cant afford but I have little choice. I am managing to work but less than 60% of what I was before. And steadily deteriorating.

Hi, I am sorry to hear of your predictament. Sadly the Trust is not in breach of duty of care in this instance. There are set guide lines for how long a pt waits for 1st apt, as long as you have not breached the waiting time then they can cancel. Check the Healthcare Commission website, this gives all the details of what the current Government waiting time targets are, and how to complain if needed and who to. All so you can find information on this site about how good your local Trust is in meeting this and other targets. With the implementation of 'Choice' you could ask your GP to refer you to another hospital with a shorter wait and less cancellations, if there is another hospital you could get to.

Sorry to hear about that its not nice havnig an undiagnosed problem if its not too personal a problem what are your symptoms there may be ppl here who have been through similar.

 

in 2003 I was very ill on and off for a whole year very flu-y and tired all the time was diagnosed with chronic fatigue then post viral fatigue then after about 8 months ended up in hospital with near liver failure from chronic glandular fever it still effects me to this day, the liver damage is permanent and I get tired really easy but there are ppl worse off

The first diagnosis I got from my GP was post viral fatigue, except I have everything but the fatigue! :confused:

 

Well my appointment with this specialist was supposed to be on the Monday, when I phoned the hospital they said it was cancelled as the doctor had been called away all week.

 

I managed to get hold of the doctors secretary and asked if I could have a private appointment, she gave me another number for another one of his secretarys at a private hospital. Rang her and she said no problem, he can see you tuesday evening. Well, so much for him being away all week.

 

So I saw him, and he's referred me to go for an MRI brain scan. He says I dont fit with having post viral fatigue. Dont know if thats good or bad news.
