Has anyone used the car park in the Walled Garden at Sunbury, since they introduced charging?

 

We took my elderly mother there a couple of weeks ago. We've never had to pay before and as she is now disabled and had just got her blue badge, we went straight to the disabled bays.

 

Now bear in mind, that the charged for bays are surrounded on all sides by the resident's parking only bays. So you are driving carefully, to make sure that you don't park in a resident's bay. The disabled bays are obviously closest to the path into the garden. They have the statutory blue badge signage, but no info about charges.

 

On walking into the garden, there were a few signs of the 'have you paid and displayed' variety. Not 'proper' signs mind you, just bits of typed paper with plastic over them.

 

We hadn't even seen the machine [in my opinion it is tucked to one side, near the resident's parking] and we had parked with the badge displayed and the time clock correctly set. We were there for only about 50mins, whilst we enjoyed a quick picnic and a walk around the garden. On our return, hey presto, we have a ticket and must have missed the CEO by about 5 mins. The pcn related to the absence of a valid ticket or time clock.

 

I emailed a challenge to Spelthorne and my fiance [the car owner] received a letter within 2 days, saying pay up or else. By this time, I had paid the £25 charge online, just for the sake of peace, but I want to challenge it further.

 

On the Spelthorne website, it quite clearly states that of the Walled Garden along with the other small car parks in Sunbury, the charges are as follows:

1st hour FREE

Up to 2hrs £1

Over 2hrs £1.50

This is in force Mon-Sun 7am to 7pm only.

 

Now I'm not quite sure just how you obtain a ticket, if the first hour is free and how do you prove you were only there for an hour? My fiance also says that as far as he can remember, it didn't say 1st hour free on the machine. If this is so, is this a legal pcn?

 

There is no signage on the disabled bays to include disabled drivers and the information next to the ticket machine, is so small partially sighted drivers would not be able to read it. I can't be certain, but on the day we visited I'm pretty sure that the 'free' car park signs in the road outside, were still in place.

 

We decided to go there so as not to tempt fate by parking on double yellow lines, what fools we were! Any thoughts on this matter would be gratefully received.
