Buchanan Clarke and Wells EoN bill

Hi There

 

I last posted in 2007 when the forum came to my aid with my bank charges, the outcome was very satisfactory. I'm hoping you can help again. I've been contacted by BCW regarding a final bill from EoN for Electricity.

 

I shared a house with two other people people from August 2008. EoN was our initial electricity supplier. In March/April 2009 we switched supplier from EoN to NPower. I don't know the exact date. As far as i know we paid every bill we were presented with. We paid what i believe was our last bill to EoN in May. We heard nothing further from EoN while living at the property. We then left the property in August 2009.

 

I've now been contacted by BCW and they have sent me a bill dated Feb 2010 for electricity supplied between 21st March and 5th April 2009.

 

If its legitamate why didn't EoN send it to us during the 5 subsequent months we lived in the property? Why am i hearing about it now?

 

Unfortunately although the bill is in mine and 2 other peoples names, the arrangement was that i paid money in to their joint account and they paid the bills. So i dont have copies of any of the bills and payments out. However we were on good terms and we had no issues with any other bills.

 

The bad news is that i no longer have and dealings with my ex-housemates. I have a work email address that is now dead so I assume they have left that company. I didn't transfer their mobile numbers when I bought a new phone.

 

My main question is does BCW have the right to pursure this debt considering I have no connection with them? I don't normally avoid paying what I owe (if I owe anything) but it would be a very convenient way out of this on legal grounds. Plus I'm not keen on stumping up for someone elses share.

 

BCW do like to move fast as I already have a letter threatening court.

 

How long do I have to investigate this? I need to speak to EoN and clarify the details. I also need to speak to NPower and try and establish if they were supplying us energy on the dates in question. Neither of whom I have a current arrangement with.

 

Is it BCW responsibility to prove the debt is legitimate or is a copy of the utility bill sufficient? Or is it my responsibility to prove I don't owe the debt?

 

 

I have just bought my first flat on my own and really do not want this to affect my credit rating.

 

Any advice would be greatly appreciated.

you don't have to prove anything

BCW have to prove YOU do owe the debt and don't let them tell you otherwise.

 

And their threats of court action are just that threats, to intimidate you into paying up without questioning the legallities of their claim.

 

Never speak to the clowns on the phone either, get everything in writing. Send them a 'prove it letter' then while your waiting for them to reply contact the various utility companies and see if you can get to the bottom of who, why and how much you owe them.

Thanks Alfwithhair. As for my issue, I've re-read the letter from BCW and it says the debt is £150.32, where as the utility bill they sent me is for £130.71. There is no explanation for the rise. They also clearly state that they are acting on behalf of their clients; E.ON. I've spoken to E.ON and there is no outstanding balance. Finally the BCW letter starts "Despise repeated requests for payments..." I've only had one request of sorts, a copy of a utility bill. These people really are muppets. Surely it's going to cost them more that £130 in time and resource to pursue this? I've had no joy yet tracking down my old housemates so can't verify what we previously paid.

 

I've written back to BCW telling them either they or their client has made an error. Also told them to delete any record of my employers telephone number, which is how they got hold of me in the first place. I've also complained about their excessively agressive and unnecessarilythreatening behaviour, although i doubt they'll care much about that.

 

I've also written to E.ON asking them to confirm to me and BCW that there is no outstanding balance. I've also complained to E.ON about BCW's communications as they are claiming to be acting on behalf of E.ON.

 

I'll certainly do a bit of research on my utility suppliers in the future and pick one with far better customer service than E.ON.

Keep us informed of the outcome and remember do not speak to the idiots at BCW under any curcumstances, no matter what they threaten you with.
