Not sure if this has been posted elsewhere, but at long last the ICO looks to be showing it's teeth after being inundated with complaints, no doubt this is thank to CAGgers kicking up a stink!

Just goes to show, every complaint makes a difference and is added to the pile...

Boo:wink:

ICO repeats jail call as complaints soar ? The Register

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

well, he isn't threatening jail, just stating he believes the court should be able to impose jail time.

we can all help by complaining to MPs about the repeated violations of this industry and about the time taken to investigate complaints - the 2 are obviously related, and IMHO the ICO needs a wider range of deterrents, including penalties for low level offences. at the moment I believe they can impose fines for serious breaches such as loss of many records from unsecured systems, laptops etc, but for other breaches such as processing data without consent (such as no agreement), maintaining inaccurate data (disputed accounts, defective DNs, illegal recession etc) there is no real effective sanction. They're not going to remove a dpa licence for it so apart from a finger wagging thats it. The ICO is so snowed under, theyre looking simply to resolve the complaint rather than punish the offender, hence many complaints are resolved with 'advice' rather than Orders.

The OFT state they have the power to withdraw credit licenses from companies. Everyone knows that, but in reality how many times have

Barclaycard had their license withdrawn? The reality is that it has never happened and will never happen.

How many times have small independent 'one man bands' had their licenses withdrawn, plenty.

The OFT is not fit for purpose.
