I have had to unapprove the piccies. They show yours and your partners signatures.

 

If you can repost with them covered up, I will then delete the one you have already posted.

Because the sheet you reposted says to refer to the terms overleaf and I saw those terms when you posted the earlier image, it had the prescribed terms on it as well as some other stuff which is why I said enforceable. You could post up the terms and conditions again so that others can have some input.

 

You said you reclaimed the charges before. Are there any more you can reclaim?

 

If you can manage it, you could try a Full and Final settlement (less than what they are demanding)

 

Otherwise, I would sugest paying what you can afford, not what they want

No more charges on this account but thanks for the tip - as for a full and final settlement... if I agree a figure would that require payment in full, assuming they accept it?

That's the question. Some will accept a F&F spread over 3 months, others will want it as a one-off payment.

** UPDATE **

Despite receiving an apparently legitimate agreement - we have now received a letter from Moorcroft stating they no longer manage this account and have refered us back to their client.

 

The last letter we sent to Moorcroft was to agree to re-start payments and asking for the current balance so we can then decide if we could afford to make a full and final offer.

 

Should we wait to hear from Barclaycard now, or should we contact Barclaycard and offer the same installment plan we had been paying Moorcroft?

 

I'm a bit confused!! I assumed Moorcroft would have continued since they provided the agreement.

They do beggar belief sometimes don't they.

 

I would hold off doing anything for now until either BC contact you or the next DCA show up

We received this letter from Wescot regarding this debt now. Seems Barclaycard have passed it on. It was actually addressed wrong and sent to a neighbour who brought it round. Obviously we don't want our neighbour getting mail like this meant for us.

 

What should we do now? As we have rec'd an apparently legit CCA should we now contact Wescot and offer a payment plan?

I'm sure there's an oxymoron in that letter. Wescot-specialist??? (but then, I am biased):-)

 

Don't ring them obviously. Send them a letter back complaining about the wrong address and the fact they have embarassed you to your neighbour.

Offer what you can afford, nothing more. If they demand an I&E form, you can refuse(if you wish) as they don't have an automatic right to know your financial situation.

Hi, following this with interest as I am getting letters from Moorcroft. I read on your post that you claimed the PPI charges, can I do this with my debt with Lloyds even though Moorcroft are now on the case and if I can does it just come off the outstanding balance? Would be great if it came to me as I couldn't half do with a bit of money as sick of being overdrawn!!

Hi Weatherwitch - We only claimed unfair charges not PPI as we didn't have that on the card. Regardless of that, any payments were off-set against the balance and so we didn't see any money - it just reduced the amount owed.

 

Stay positive and read as much as you can on this site for guideance and keep the forum updated.

Hi Silverfox1961, sorry for butting in on this thread, but have been trying to read through as much as I can. I am about to start with my credit cards, checking the agreements, and had posted one up from MBNA to see if anyone could tell me if t was enforceable ?? I had no replies !! Dont know if i am doing something wrong, finding the new layout a little hard to navigate !!

Update: we've had a reply from Wescot accepting our monthly offer to pay but only giving us until 10th Nov for the first payment. We only read this letter today, and they have not given us account details to set-up a standing order. I called Wescot for this info and we've written to them by recorded delivery telling them the first payment will be on 1st December but they insist they want a payment otherwise they will issue a default notice. Can they do that?
