Cap1 Cancelled Account - No Default Notice - No CCA

Apologies for double posting this in Capital One group but getting views but no replies, Anyone offer any advice at.

 

Hi, just received a letter this morning from Cap1 saying my account is now cancelled and I owe them £648.

 

I sent in a CCA Request in May which was signed for but never received anything back from them.

I have not received any default notice from them either just this letter today.

 

Anyone have any idea of how I should respond.

Update,

 

Now getting CFS on the phone to me regarding the above account.

Told them to put everything in writing and have an account in dispute letter ready to send.

 

Anyone offer any advice over the 1st letter canceling the account while CAP1 were in default of the CCA.

Have now received a letter from Cougar Final Services over this matter, Have the bemused letter ready to send today when post office opens.

I would be sending the A/C in dispute letter to Cap1 and the bemused letter along with the telephone harassment letter to CFS.

 

I also think it's time you sent Cap1 a SAR. You want screenshots from your account history to find out if they did default you and the dates of default. The problem with defaults is that they don't have to prove they were sent, just proof of issue and that should show on your screenshots.

 

Cap1 have two account systems (ProphIt and Apollo). I found the Apollo system was more comprehensive than ProphIt but I think you should be asking for both.

You mention 2 account systems, (ProphIt and Apollo) Are these what Cap1 use to admin the accounts, one or the other.

From my own experience, when you do a SAR, they send you account history from the ProphIt system but not from Apollo (why? No Idea) Both contain account history but the Apollo goes into a bit more detail.

Example:

 

On one of my screenshots from ProphIt it said on a particular date, "Returned mail received"

 

On Apollo, same date," Returned mail received and destroyed"

 

Not much difference but in my case it meant a lot.

 

I did have to issue court papers before they finally gave me the Apollo

( delivered before case so I discontinued)
