Complete brake failure after mot and service

Hi all, i'm wondering if there's anyone out there who could help. I know nothing about cars but will explain as best as I can. I put my car in for an Mot and service on Monday and got it back yesterday. It failed the mot, needing 2 rear springs, 1 front drop link and 2 rear drop links. This work was done, re entered for the mot, passed and i picked it up late yesterday afternoon (Tuesday). The total bill came to an eye watering 632 pounds which i thought was pretty steep however I paid and drove it home, a distance of about 500 yards. Later that evening i took it out for a short town run and thought my brakes seemed weak and unresponsive so i turned round and made for home again. Coming to a busy junction my brakes failed completely, resulting in me having to take evasive action to avoid hitting another vehicle and narrowly avoiding a major accident. As you can imagine i was pretty shaken up, I got help from a mechanic friend who had a look and told me that my rear brake shoe and pad was completely missing, the garage had failed to replace it properly when they had taken the wheels off to replace the new spring. I went round to the garage this morning, furious and all that was said was they'd take it in and repair the brakes, no explanation or apology. I feel this is unacceptable due to the incompetence of the garage and the risk of serious injury to myself, my 2 kids who were in the car at the time and not to mention other road users. My friend says i should report them to Vosa, like i said i'm a complete novice where cars are concerned, I was recently widowed and my husband always dealt with the service and mot for our car so i don't have a clue what to do! Can anyone advise me of what my rights are in this situation and what i should expect from the garage in recompense? Thanks in advance!!

Your rights are certainly to have the work done free of charge and also to be able to recover any other loss you may have suffered.

 

That is probably about it, I'm afraid.

 

However, you should certainly report the matter to VOSA and also to Trading Standards.

 

This kind of careless repair is extremely dangerous and the public needs to be protected.

Unfortunately it's not a VOSA matter so don't be surprised if they are not interested.

 

Another example of why the industry needs regulation!

It should be a VOSA matter, as when retesting the vehicle, the repair, the advisories and anything that is likely to be affected by the repair (such as the brakes, wheel security,etc.) should be checked, possibly to the extent of carrying out another roller brake test.

Not on an MOT re-test. It's only the said items that failed. They won't even look at the advisories as these are.........advisories.

 

When I was doing mot's(about 6 years ago) on a re-test you had to check any/every item that could be affected by the failed item, so any item removed to fit the springs and drop-arms, have to be checked.

 

It needs reporting to Vosa anyways.

Hi, Thanks to everyone who posted a reply. Re the Mot re-test, I've been advised that since the wheels and brakes were removed to fit the new springs then the brakes should have been tested in the re-test. Vosa have been informed, also trading standards, whether it will be taken further is anyone's guess. This wasn't about financial recompense, more to stop the garage from making dangerous mistakes like this again. Since my last post, the garage picked up my car to fix the brakes and to date (Saturday) I haven't received the car back. I did receive a phone call from them to inform me that they'd charged me too much for the oil they used for the oil change and they wanted to refund me, this is going to sound ridiculous to those reading this but on the bill I received (and paid for) they charged 114 quid for 4 litres of oil!! My fault for paying the bill without querying it, I only started to think again when a male friend pointed it out to me and said it was extortionate. I can't help but think that they would never have refunded my money for the oil if this fiasco hadn't happened. A perfect example of an novice (me) being taken for a fool. At least i can say i know better now and in future won't be so quick to blindly trust a garage without a few recommendations! :-| Thanks everyone!
