Hi there

I entered into a protected trust deed back in 2004 and stupidly ended up defaulting on it (stopped paying into it basically) I let the company know who set it up for me that I was moving abroad in 2005

I then returned to England in 2007 (where I still reside) and heard nothing.Even my credit file had nothing on it which I last checked in 2008. Ive been able to open a bank account and I'm close to completion for a mortgage with my fiance.

Now out of the blue recieved a letter from a debt collector Rockwell who are working on behalf of their client Tessera Portfolio Management and the original lender being Intelligent Finance a demand for £6300 Which I am sure was part of the original Trust Deed.

Does anyone have any advice on this and if i should send off a 'prove it' letter or should I ignore there demand

Any advice would be very grateful

Cheers

SG

Hi scotsgeezer,

It's going to be important to understand what happened when you defaulted on the protected trust deed. The Trustee may have resigned from the case or they have have looked to sequestrate (bankrupt) you.

You might be able to get some information about this from the forum on ** commercial link removed *** where there are a couple of Scottish insolvency experts that answer questions.

If you were sequestrated there's no need to do anything as the debt will no longer exist.

Thanks S for your reply..

Will have a look at the link. But if I have been sequestrated surely I would have known by now though either through letter or on my Credit report?

Thanks again

I would have thought so too unless the trail was lost amongst the move abroad and subsequent address changes?

If you didn't complete the Trust Deed then the creditors are well within their right to come chasing you for payment again. Certainly check your credit file to see what is what :)
