Cheers for that, but I owe Swift around 23k and from the sale there will be a surplus of 20k, could/should I contact Swift and see if they would accept that surplus as a final payment.

Has a sale been agreed? If you don't already have an up to date statement from Swift you should write to them (by recorded delivery), asking for a breakdown of the £23k. There's probably a load of arrears charges been added and you need to claim those back (i.e. have them deducted from the outstanding balance).

Hi Guys, just got off the phone to those parasites Swift and they have informed me that my account stands at 35k, when I asked how does a 15k loan turn into a 35k one, they simply replied, arrears, late payment charges etc, but they have promised me a breakdown of these fees(not holding my breath).

If I get these documents is anybody willing to scrutinise them for me and see how illegal the agreement was.

Agreement will be ok, (well sort of) we know from experience the problems with the Swift Agreements. It is the charges which will be unlawful..not illegal.

 

Swift are not a nice company to deal with, search for swift on the Forum and then read the problems.
