Does anyone know whether Additions have the right to charge me a late payment fee after I paid early?

 

I made a payment for June Statement on 2nd, then I made a second payment on the 9th to cover me for the next statement but the new statement wasnt' produced until the 12th so because I've only paid July's payment today (which was apparently due by the 10th) Additions are claiming that my payment was late, when in fact it was just paid too early. I have emailed them and said this but I'm waiting for the reply, is there anything I can say/do if they refuse to remove the late payment charge?

They've added a late payment fee to my account, assuming because I made the second payment before the 12th they've included both in the same month, have emailed them but not had a reply yet.

You can make as many payments as you like in each statement period so long as there is at least one made between the statement issue date and the minimum payment's due date.

 

From what you describe, you will have been correctly charged.

as its an unlawful fee it can be claimed back with interest anyhow.

indeed as its is not an individually negociated charge it is unlawful as per section 5 of the uttcr1999

Finally if you succeed with your claim please consider a donation to consumer action group as those donations keep this site alive.

Generally Caggers have been very successful in getting Catalogue charges refunded-without the need for any Court action.

Just checked my junk mail, although I used their online 'contact us' page to send a message about this it was bounced back to me...

Just had a reply from additions who say I paid after 3rd July so late payment fee added, just replied to that informing them that I actually made my payment on 9th June... so when they reply to argue that I didn't make it between issue of statement and due date I can argue that it's an unlawful fee? any suggestions how I should phrase this?

i wouldn't bother

 

they are unlawful, they cannot justify them as 'true costs'

This is how they do it, you pay early in the same month, before the next month;s statement is printed and the computers are programmed to read that as an extra June payment, not the payment for July. Argue until you are blue in the face, the call centre operatives do not understand and neither does the accounting department. it is read and assumed it is an extra payment for the month of June, not the next month's payment.

 

Frustrating I know, but I would push to get the late payment removed. Do not fool around with the call centre operatives write to the Company Secretary at the registered head Office and include copies of statements with the payments you have made to them. Insist that this late charge and the associated interest it has attracted be re-imbursed or credited to your account within 28 days.

 

You will find the registered head office address inside the catalogue.

After several emails moaning at them about this they've removed the late payment fee as a 'goodwill gesture' and told me that I must pay within every statement and not early :-S... so basically if i know i'm not in a postition to pay within a certain time period I'm better off not paying anything than paying early.... go figure....

Check your next statement and if there is a discrepancy, you know the interest has been added, then go for them.
