Towing whilst someone sat in car

This is a completely hypothetical situation, just wondered if someone could clarify something for me as I was having a discussion with a friend about this.

 

If you are clamped on private land, with the threat of towing, what would happen if you sat in the clamped car and they starting towing the car?

 

If they towed the car, they would also tow you away. Would this then be kidnap or some other offence?

Not an offence, per se - just like a caravan with a lit gas fire within, it would be irresponsible to attempt to move same because of the inherent dangers. A clamped car with a passenge inside is in the same situation. The vehicle cannot be lifted. Now, if on a public street, a police officer could request the car be vacated, and arrest the person for obstruction if they did not. But on private land, this would be difficult to achieve unless by bending the public order rules. It shoulds be seen for what it is, a civil matter.
