At the begining of the year we were served a statory demand for unpaid council tax. We wrote back straight away and disputed the amount, in april we recieved a letter basically saying we owed it and there was nothing we could do about it as it was our mistake, so we replied with an offer of a payment plan and asked for them to respond to that letter.

In June we got served the bankcruptcy petition, they hadnt bothered to reply to our payment plan. We managed to borrow and sell everything worth anything, and paid off the whole sum before the court date. We then recieved a letter for costs £1042.

We went to court yesterday to have the petition dismissed but now we have to agree to the costs, which we dont as we dont think we should have been served the petition before they had responded to the payment plan.

This means we have to go back to court for the court to agree to the amount for costs. We are on income support at the moment, does anyone know where we stand on this

Hi SJ. Did you appear in court at all ? Did you get into any dialogue with the council ? Even having a payment plan is not enough to set aside a stat demand. If you had applied to dismiss the petition then a sympathetic judge may not have allowed costs. You were/are also, by the sound of things, eligible for legal aid too.

In the paperwork may I ask if there was an 'affadavit' stating how the demand had been served ?
