Where do i stand with my claim?

Hey, please help. I do not have a scanner so i will type out my agreement and hopefully someone can kindly shed some light. Am really confused about the judgement and what this means for my claim, i took out the loan in 2006 these are not exact figures but very close. I tried to cancel the PPIlink3.gif ages ago but lender did not respond, it's now being challenged by a solicitor. I worked out that i have so far paid back incl.interest over £9000 until the dispute of which i was waiting for the judgement on the Walker V. Southern Pacific.

 

Total amount of Credit (B+C) = 20990 (A)

Amount of Credit for Cash Advance = 18000 (B)

Amount of Credit for Insurances (K) = 2990 ©

 

Duration of Agreement = 180 months

 

Insurances 1st Person Lifecare 24 Cash Price = 180.00 (D)

Optional PPI = 2800 (J)

Total Cash Price = 2980 (K)

Amount of each momthly payment = 330

Number of monthly payments = 180

Apr variable = 18.9%

Total Charge for Credit (M+O)= 36000 (L)

Acceptance fee = 255 (M)

interestlink3.gif Charge = 35745 (O)

 

Is mine enforceable or not?

Hi Juce

 

Has a subject access request been done?

 

If so look for any paperwork relating to commission payments on insurance - if you have got this look at hurstanger v wilson

 

If you haven't got it write to them and ask for the insurance underwriting sheets.

My PPI claim is being challeged by a solicitor so my guess is that they have requested SAR? Also my loan agreement is being challenged by another solicitor so am guessing they would have requested the same? Not sure when the SAR applies, whether it's for PPI challenge or loan enforceability. It all got so confusing for me so i let solicitors deal with it plus my lender was being such a pain.

why are you using a sol?

do it yourself........

 

use a mobile phone or a digital camera then if no scanner

 

scan your agreement

remove all pers info inc barcodes etc but leave all figures and dates.

goto one one of the many free online pdf converter websites

convert the image to pdf format.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

browse to your pdf file and upload it

hit close this windows at the bottom below upload it box

it matters not if your agreement is un-en

the debt still exists.

an un-en agreement is not some magic bullet that wipes debt out

no matter what crap these reclaim co's claim.

 

utter bull sadly

I don't believe it is unenforceable, i just wondered where i stand in relation with the Walker v Souther Pacific judgement.

If you have PPI on the agreement it is highly likley that welcome either paid a broker, or themselves, a commission.

 

If they have then you will only have to pay back the amount you actually borrowed - not the interest on top.

 

Read - Hurstanger v Wilson

 

Write to welcome and ask for the underwriting sheets for insurances.

I stopped making my payments while this was being challenged by my solicitor. I spoke to him today and he says he will be writing to me soon. Can someone please tell me whether i need to contact my lender and resume my repayments or should i wait for them to contact me?

I know it's nothing to do with PPI. My agreement was being challenged and solicitor was waiting for the Walker v SP judgement so he can tell me where i stand. You wanted to see my agreement so i posted it here, am just looking for some advise on what to do.

 

I have not challenged the PPI yet.

Trouble is that i don't know what i need to do, am looking for some advise, i don't know whether i have a case on not. They asked me to stop making payments while they are chellenging my agreement, now that the Walker V SP case has been decided, i don't know what else, can you help?

thats stupid advice for a start.

 

have had any letters from welcome complaining about this!

 

everyone has a casae for reclaiming PPI

everyone with a welcome agreement is guaranteed to have a reclaim case and win.

 

rarely are welcome agreements totally water tight and have other holes in them inc other rip offs.

 

do some reading in this forum and in the PPI forum.
