Hi there,

Two months ago I contacted Virgin Media to open a broadband account. The installation was a real ordeal (it took a month) and to compensate me one of their salesmen offered me the first two months completely free.

To my surprise I received today my first bill for the first 2 months (£50). I contacted them to tell them I was supposed to get the first 2 months free. They replied that they never do this kind of thing and that it was not mentionned in the system anywhere (I am just entitled to discounts for the first 3 months that everybody gets).

I called them three times half an hour and they say they don't want do do anything. Now since I haven't paid they disconnected me and I don't know what to do... I'd be really happy to switch to another provider but I don't know about the consequences if I don't pay those first two months (and I have a 12 month contract). Should I just give up and pay ?

Thanks

Renaud

The main issue with not paying is they'll wreck your credit file.

Personally, I'd pay then follow their complaints route. Have you got something in writing showing the discount?

If in doubt, contact a qualified insured legal professional (or my wife... she knows EVERYTHING)

Or send a cheque or postal order payable to Reclaim the Right Ltd.

No unfortunately. The contract they sent me does not specify anything. I should have had a closer look at it in the first place...

I think I will just pay, I guess it's just too much hassle if I don't...

Can believe it.

VM are very reluctant to put anything in writing thats not in their terms and conditions.

You could pay it and then sue them for the 2 months, but the burden of proof will be on you to show that there WAS an agreement for a waiving of the 2 months.

If it was done through VM services (by phone) they SHOULD have it,and you can request either a copy or transcripts of the call using a subject access request.

Just make sure that they cant deny on the grounds of any request being non specific.

Meaning-ask for transcripts/recordings of calls handled between XXX and XXX and better still if you can tie it to an approximate date/time.
