Hi guys

Need a little advice. My wife works for a large company and was "offerred" the oportunity to change her job role. The deal was that she would stay on her supervisor rate of pay but would also earn commission.

 

6 months on she is still being paid a lower rate than before her change of possition & normally does not get the correct ammount of commission. Everytime she raises the isue with the manager, he says he will look into it & then does nothing!

 

Where does she stand? She has a written contract with the higher rate of pay?

A formal grievance is the way to go. She has a contract offering a set rate of pay plus commission and is not being paid it. In those circumstances this counts as an Unlawful Deduction from wages contrary to the Employment Rights Act 1996. Either they sort it out, effective with the next payroll (and backdated to the date of the change in contract) or she reserves the right to recover the money through legal action.

Any advice given is done so on the assumption that recipients will also take professional advice where appropriate.
