    • Hi everyone   I joined DL a few months ago. Was offered a discount as "friends & family" because I knew a friend who works there. A few days later, I upgraded my membership to Platinum and specifically requested the Spa retreat as well. I was issued a new card, which had correctly  labelled that it was Platinum card with Spa retreat. And payment was agreed at £125 per month.  No worries because I have been going 6 days a week. Everything going well for a few months.   Then i lost my card. Was issued a new one. Went to use access the spa and wouldnt let me in. I asked what's wrong and they informed me that my membership did not include the spa. Now they have confirmed that there was a glitch on the salesperson's app that allowed the wrong price to be accepted.   This glitch has been brought to managements attention and has now been fixed. However, they now want me to pay the correct price to access the Spa.   Surly, they have to honour the original agreement made with me?  or do they?   Thanks for your help!   Jameson  
    • Point out that the small claims process is very simple and straightforward. If there is a hearing then it is very likely to be a telephone hearing and as long as one knows the steps then there is no reason to be unconfident about it.
    • We should be able to obtain opinion regarding expected life from the original plumber as he is no longer active in the trade, so no issue with future relations with the merchant..   I will talk to my neighbor and explain what he  needs to do, clearly it will be up to him to proceed with the claim via the suggested route   Thank you for your help.

    • I came across this discussion recently and just wanted to give my experience of A Shade Greener that may help others regarding their boiler finance agreement.
       
      We had a 10yr  finance contract for a boiler fitted July 2015.
       
      After a summer of discontent with ASG I discovered that if you have paid HALF the agreement or more you can legally return the boiler to them at no cost to yourself. I've just returned mine the feeling is liberating.
       
      It all started mid summer during lockdown when they refused to service our boiler because we didn't have a loft ladder or flooring installed despite the fact AS installed the boiler. and had previosuly serviced it without issue for 4yrs. After consulting with an independent installer I was informed that if this was the case then ASG had breached building regulations,  this was duly reported to Gas Safe to investigate and even then ASG refused to accept blame and repeatedly said it was my problem. Anyway Gas Safe found them in breach of building regs and a compromise was reached.
       
      A month later and ASG attended to service our boiler but in the process left the boiler unusuable as it kept losing pressure not to mention they had damaged the filling loop in the process which they said was my responsibilty not theres and would charge me to repair, so generous of them! Soon after reporting the fault I got a letter stating it was time we arranged a powerflush on our heating system which they make you do after 5 years even though there's nothing in the contract that states this. Coincidence?
       
      After a few heated exchanges with ASG (pardon the pun) I decided to pull the plug and cancel our agreement.
       
      The boiler was removed and replaced by a reputable installer,  and the old boiler was returned to ASG thus ending our contract with them. What's mad is I saved in excess of £1000 in the long run and got a new boiler with a brand new 12yr warranty. 
       
      You only have to look at TrustPilot to get an idea of what this company is like.

    • Dazza a few months ago I discovered a good friend of mine who had ten debts with cards and catalogues which he was slavishly paying off at detriment to his own family quality of life, and I mean hardship, not just absence of second holidays or flat screen TV's.
       
      I wrote to all his creditors asking for supporting documents and not one could provide any material that would allow them to enforce the debt.
       
      As a result he stopped paying and they have been unable to do anything, one even admitted it was unenforceable.
       
      If circumstances have got to the point where you are finding it unmanageable you must ask yourself why you feel the need to pay.  I guarantee you that these companies have built bad debt into their business model and no one over there is losing any sleep over your debt to them!  They will see you as a victim and cash cow and they will be reluctant to discuss final offers, only ways to keep you paying with threats of court action or seizing your assets if you have any.
       
      They are not your friends and you owe them no loyalty or moral duty, that must remain only for yourself and your family.
       
      If it was me I would send them all a CCA request.   I would bet that not one will provide the correct response and you can quite legally stop paying them until such time as they do provide a response.   Even when they do you should check back here as they mostly send dodgy photo copies or generic rubbish that has no connection with your supposed debt.
       
      The money you are paying them should, as far as you are able, be put to a savings account for yourself and as a means of paying of one of these fleecers should they ever manage to get to to the point of a successful court judgement.  After six years they will not be able to start court action and that money will then become yours.
       
      They will of course pursue you for the funds and pass your file around various departments of their business and out to third parties.
       
      Your response is that you should treat it as a hobby.  I have numerous files of correspondence each faithfully organised showing the various letters from different DCA;s , solicitors etc with a mix of threats, inducements and offers.   It is like my stamp collection and I show it to anyone who is interested!

hi can anyone offer any words of comfort or advice i had a suspended eviction made last august and after a few problems,one being made bankrupt,not through choice i have an eviction date for the 12th monday and court dte for the friday the 9th,i have 2200 arrears on the court order which the mort com want paying as they are oposing my n244 form which has been entered,i have 3 children under 11 and no savings or way of paying the 2000,i offered 500 a month 387 mortgage and rest off arrears but they said i had to go back through court as i had broken the order previously,shelter have helped me fill the form out and submit it and said i have a decnet chance as its the first time ive been back before the judge,its just started to worry me alot more now with a week to go,ive info our oldest we may be moving next weekend so as not to uprrot her on the spot,is it also worth mentioning to judge my 3 yr fixed term comes to an end this month lowering the payments and allso if the lender pushes to sell i will owe more than if they let us stay as the council want there discount back within 5 yrs i believe,sorry its a lot to write out just trying to give you the jist of it

If Shelter have helped you with the form and said you have a good chance then I believe you will be ok. What did you put in Q.10 of the N244?

If you can let me know tomorrow what it says in Q10 of the N244 then I can advise if you need to take an additional statement to court for the hearing.

thanks ellen,the man from shelter said not to be too worried but with three kids and no where to go a weekend isnt a long time to get out :( im hoping i can put my self across well at court and just explain the situation and how i can repay it,i offered them at 110 a month of the arrears but ive seen mentioned you can ask for it over the remainder of th mortgage term,should i mention i am offering to pay them off quicker and should i mention about the council wanting there discount back and mortgage been worse off if they go for eviction ,i am bankrupt and have no assests just to make it worse,the only comforting thing is me and my partner are working well together in this and holding our heads up,for now !
