    • Isnt there some indication in there of at least intent to inform arbuthnot? IF he wasn't then it would seem to be Vennells decision to keep him 'uninformed .. Although seems to me if arbuthnot was unaware - he was either incompetent or should have very detailed records of denials. Seems vennells is constantly at the core of all the lying about all these issues though.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hello all.

 

regarding wonga, i really need some help at the moment as THEY HAVE TOOK £77.29 (in two payments) OUT OF MY ACCOUNT TWICE.

 

i registered at the back end of may and have used them 4 times since - just for 2 x £20 loans and 2 x £40 loans.

 

one thing i noticed when they took the repayment out of my bank account for the first (£20) loan I took was that it didn't show up on my online bank statement straight away and took a few days to. i wasn't too concerned at first but it's caused me a big problem.

 

the first 3 times i loaned money (2 x £20 loan, 1 x £40 loan) they took the money out of my account on the agreed date and i received the confirmation text and email from them to say so and checked my account and the money had definitely left my account.

 

however, in the case of one of the £20 loans (paying back £25.75) and the £40 loan (paying back £51.54), on the day these repayments appeared on my statement (a week later for the £51.54 payment!) THEY TOOK THIS MONEY OUT OF MY ACCOUNT AGAIN! even though i had already paid it on the agreed date. i knew exactly what was in my account and that amount (£77.29 total) was missing and only wonga could have took it.

 

i called them up as soon as i realised expecting them to say it was a mistake and that i'd be refunded and couldn't believe it when they said they had nothing at their side to say they had took the money out twice. they said that i had paid on the agreed date and that sometimes it takes a few days to show up on my bank statement but they hadn't took they money out twice and to prove it basically.

 

i contacted my bank and they said that wonga had took the money out but said they couldn't have took it out before because it didn't show up on my statement, BUT I KNOW THEY DID TAKE IT OUT! how can i prove this? how the hell can they just take the money out again in the first place?!

 

thing is, i was due to pay back the last loan i had with them (£45.50 total) just yesterday and part of the money i had in my account was to repay it, but as wonga has took that money out of my account again it meant i didn't have enough money in there to pay them and now owe them an extra £15, even though it was their mistake.

 

i'd never used anything like this before so this is all new to me. i really don't know what to do or how i can prove they took the money out of my account twice so would really appreciate any help and advice here.

Job number one is to cancel your card straight away. That will stop them raiding your bank account.

 

Next job is to get together all the proof you can - emails, copies of bank records, showing what they've taken. Once you've done that look through everything really carefully as it may be worth contacting OFT and Trading Standards.

Get your bank to give you a new account number as the old one is compromised, as you sent Wonga your card details (photocopy of card) they have your account no too and will take more money out when they feel like it...

I agree with Cornetgirl, regarding the action to take. I would also tell the bank that you did not authorise the second payment and that you want them to investigate it.

contact trading standards which is easy just send an email. Personally I would complain to fos means filling in their form.

 

I would seek compensation as well from them at their rates of interest!
