Minster Baywatch lose in court

A report from today:

 

Mr Wilson (pictured) turned up to represent Minster Baywatch.

He is the Managing Director of a company called Bransby Wilson Ltd.

Apparently they hold the contract with Rank and Minster enforce the ticketing.

 

He couldn't really articulate who Minster Baywatch are and how he was representing them.

He said they are a Ltd company which they are not.

 

He couldn't add up how the £150 they were claiming was made up.

His total of the breakdown came to £110. £60 fine, £10 DVLA and £40 debt collectors.

 

He said he wanted to go for Trespass and breach of contract.

The judge explained the law and steered him down the path of contract alone as no damage was done regarding trespass so no losses would be due.

 

With regards to contract the judge said it didn't really matter that I didn't see the signs as they are big, bright and quite abundant. Therefore I probably did enter into a contract by dismissing them.

He used an analogy about old buses having a conductor to take the money and you getting off before he got to you.

 

However, and this was the crutch!

What losses have they really incurred?

 

The car park was empty as the premises were closed.

They have to pay someone to patrol the car park even if no one parks there.

So by me parking there for 10 mins, what additional cost have they incurred.

The answer is none so the claim is dismissed.

 

The Judge said he could ask for permission from a judge to appeal and could ask him now or ask another judge.

 

Mr Wilson had a face like thunder and promptly stood up and walked out.

 

The Judge was really thorough and put me through the mill.

I really didn't know which way he was going to go until the very end.

 

Great news though and a real moral victory for the man in the street.

Great result. Minster have worried a few posters on the forum - this should put their minds at rest.:)

It's just the usual - person starts a thread and then they are helped off-board through email.

 

I only learn of the outcomes through email.

 

I think filfthysurfer wants a soundbite from me :D
