Hi All, some time ago I had charging order placed on my house. At the time I was unaware that credit agreements drawn up before 2007 could be unenforceable. Is it possible for me to contest the charging order now based on the credit agreement not being drawn up properly?

You will need to get a court to certify the agreement unenforcable first.

 

Then technically i suppose you could contest the order.

you first need to have the CCJ set aside and then the charging order. It's not easy to do either.
