    • Thanks for posting the CPR contents. i do wish you hadn't blanked out the dates and times since at times they can be relevant . Can you please repost including times and dates. They say that they sent a copy of  the original  PCN that they sent to the Hirer  along with your hire agreement documents. Did you receive them and if so can you please upload the original PCN without erasing dates and times. If they did include  all the paperwork they said, then that PCN is pretty near compliant except for their error with the discount time. In the Act it isn't actually specified but to offer a discount for 14 days from the OFFENCE is a joke. the offence occurred probably a couple of months prior to you receiving your Notice to Hirer.  Also the words in parentheses n the Act have been missed off. Section 14 [5][c] (c)warn the hirer that if, after the period of 21 days beginning with the day after that on which the notice to hirer is given, the amount of unpaid parking charges referred to in the notice to keeper under paragraph 8(2)(f) or 9(2)(f) (as the case may be) has not been paid in full, the creditor will (if any applicable requirements are met) have the right to recover from the hirer so much of that amount as remains unpaid; Though it states "if any applicable ...." as opposed to "if all applicable......" in Section 8 or 9. Maybe the Site could explain what the difference between the two terms mean if there is a difference. Also on your claim form they keeper referring to you as the driver or the keeper.  You are the Hirer and only the Hirer is responsible for the charge EVEN IF THEY WEREN'T THE DRIVER. So they cannot pursue the driver and nowhere in the Hirer section of the Act is the hirer ever named as the keeper so NPC are pursuing the wrong person.

We stopped for a quick meal in Mcdonalds and were there fir around 30 mins. If you think your stay will exceed the stated maximum parking time then please speak to a manager in advance.   Your number plate is scanned by our Automatic Number Plate Recognition (ANPR) system when you enter our car park, and then again when you leave.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I hope somebody can help me.

 

I owe about £570 to Scottish Power.

 

In the past I have had a weekly payment card and I paid £17 a week for my gas and £17 per week for my electric

but £34 out of my weekly tax credits being a single mum working 25 hrs a week, I soon defaulted.

 

I have had umpteen conversations with scottish Power and finally had a gas card meter installed about 2-3 months ago.

 

The £570 odd that I owe in for the electric and this is where the problem lies.

 

I have tried explaining my situation to SP repeatedly and they never seem to want to help or understand my difficulties.

 

They wont put me on another payment plan unless I clear a large chunk of the debt (I wouldn't be phoning them if I could do this?),

they sent a meter guy around over 18 months ago who told me that he couldn't physically fit the meter

in as my electric panel thing outside my front door is central to all the other flats in the building so theres not enough room for a meter.

 

SP want me to pay £69 a month on DD and I simply cannot afford this.

 

I come home from work today to an envelope pushed through my letterbox with a calling card inside it.

 

HANDWRITTEN on the envelope is my name and a note from my caller that reads as follows:

"Urgent letter of intent to apply for a warrant of entry & possible loss of supply & possible locks changed.

.please get in touch so I can resolve this for you, many thanks"

 

and the card inside is from Power 2 Contact warning me that if i dont contact them within 24hrs that their next course of action is to apply to court for a warrant of entry.

 

I am worried beyond belief hence I am writing this at 1am unable to sleep.

 

I am on my own with a young child,

 

I have no money to offer this man who I have spoken to tonight on the phone and is coming round on Thursday 1st July to discuss how we can resolve this.

 

I am in severe financial difficulty and also repaying rent arrears which is crippling me.

 

I have no one to turn to and need some advice desperately.

I am beside myself. I don't know how to handle this guy who is coming round. He made himself sound very pleasant on the phone and seemingly wants to 'help' me and said he will help me if it gets to court - I told him that I didn't appreciate his handwritten envelope informing me of a possible change of locks and that he had worried me sick. He then proceeded to tell me that I seemed like a very nice person but 'there are also alot of dishonest people out there' - didn't make me feel any better. I am suspicious of him and dreading his visit.

OK P2C are by no means Bailiffs, and they would most certainly not be employed by a court as they are not proficient nor professional enough to carry out certified court business.

 

They are a part of Credit Solutions, who fortunatel;y are members of the CSA Welcome to the CSA

who will take a very dim view of their blatant untruths regarding changing your locks!

I know it is difficult, but you really do need to stop calling them on the phone, as you will have no evidence to back you up should you need to.

 

Priority is your rent, council tax, tv licence, court fines, tax ,national insurance, and utility bills, however water arrears can be put with your non priority debts (Credit debts)

What needs to be made clear here is that YOU should tell them what YOU can afford to pay each month/week, they have clearly set the rate far too high for you to comfortably manage, so if it takes another two years for you to get the arrears down then so be it, you don't need to give them an Income & Expenditure sheet, just tell them what you can afford to pay each week/month.

 

As for P2C they definitely DO need reporting immediately to the OFT/TS via Consumer Direct

 

Don't ring them EVER. Tell SP that you will not enter into any conversation with their chosen 3rd party, and if they continue to abuse and harass you you will look at taking legal action against SP themselves.

 

Consumers may also be able to assist you in this, but contact Consumer Direct soonest, they will be able to advise you clearly.

 

Print this letter off and keep it by the front door, in case anyone from P2C foolishly knocks your door.

If this is the P2C guy tell him to foxtrot oscar, don't let him into your house, he IS NOT a qualified Bailiff, nor is he Legally qualified.

 

Don't ring him anymore, they have absolutely NO powers over you, they have NO LEGAL QUALIFICATIONS nor any LEGAL RIGHT to enter your property least of all ring your bloody doorbell, tell him to sling his hook if he turns up hand him the letter template and shut the door in his melon head.

 

Don't let these fools intimidate you please.

Put another way, if I were to knock on your door, and say that I was there to collect money off you in order to stop further action or court action being taken, would you give me some money??

 

Will be back on later, off to get some beauty sleep, theres not a great deal you will be able to do until office hours, but there is always someone on here no matter what time of day or night....

Thank you for your information, I do not have time to look at the links this morning as I have to go to work, though I have looked at the doorstep letter to give to him. I am so worried as I only have tonight to look at all this information before he calls tomorrow.

If I give him the doorstep letter (which I have emailed to my work email address in order to print it out), what course of action do I take then? Do I contact Scottish Power directly? I am dreading him turning up as I am not good at face to face confrontation :(

I am sorry to hear about your situation. First things first - we need to stop the debt action on your account so that we can fully review your situation and see what options are available to you. If you PM me your ScottishPower account number tonight when you get back in from work, I will stop all action on your account and see what we can do for you.

 

I appreciate that it can be very difficult when you are trying to pay off other arrears as well as your ongoing expenses. If you send me your details I will do everything I can to help lower your monthly outgoings.

 

The prepayment meter would allow to you repay the debt at a rate of £3.30 per week. If you are unable to have a prepayment meter installed then we can look at alternative payment options to help spread the balance for you.

 

If you receive any benefits, the job centre can set up a payment arrangement called Fuel Direct which allows you to pay £3.30 per week to clear the debt. This will again help to lower your monthly outgoings and will be taken automatically from the benefits you get.

 

If you contact me I will confirm whether you qualify for this.

 

According to the job centre, they prioritise payments as the following:

 

1. Housing Costs

2. Rent Arrears, service charges for heating, lighting

3. Fuel Costs

4. Water Charges

5. Council Tax and Community Charge arrears

6. Fines

7. Child maintenance

8. Integration loans

9. Eligible loans

10. Overpayments of benefits

 

We will also be able to discuss the gas and electricity you are using and see if you can be more energy efficient to also help lower your monthly outgoings.

I was in a similiar situation to you last year however SP had actually got as far as applying for the warrant (court date was a few weeks away) I made countless phone calls to Scottish Power and to be quite honest everyone I spoke to was nothing short of an ignorant muppet (sorry SP)

 

I then received a recorded delivery letter from Scottish Power saying that they wanted to help me. This letter made me see red and I rang SP and explained that I had repeatedly tried to sort this out and no one wanted to help me so what on earth was the point in sending me RC letters.

 

This phonecall saved my sanity, the lady I spoke to was polite and helpful, she was flabbergasted that no one else had sorted it out for me. Five minutes or so later and sorted, all done, payments on DD that I could afford and application for warrant cancelled.

 

The moral of my story, dont give up. If the first person wont help then ring back and speak to someone else or in your case PM your details over to SP.

I am in a very similar situation to worriedlonlymum, I have a bill of £470 which my controlling ex partner was suppose to have paid. But after a particular violent out burst that involved me ending up in hospital and him being arrested I found the strength to get out of the abusive relationship. The problem is I don't work and have now been left with this massive bill. I struggle on the phone and have emailed Scottish power countless amounts of time but no one is willing to listen to my email and reply to my pleas for help to pay in installments.

Then yesterday I come home to a note saying I must call with in 24 hours or power2contact will apply for a warrant to enter my property. I'm terrified and this is the last thing my poor son needs.

I'd appreciate any advice :-(

Firstly, try not to panic, powerless2contact are NOT bailiffs, they will NOT be able to get a warrant to enter your premises, they are a very immature clown outfit who have no legal powers to do anything other than to send out misleading fraudulent pieces of paper claiming they can turn the moon blue.

 

DO NOT RING them.! They are useless, they WILL NOT help you in any way shape or form, ignore them.

 

Complain, IN WRITING to SP about their use of such a foolish immature third party that they, SP, are solely responsible for, inform them that you will not be dealing with their chosen third party DCA as they act outside the law, and any subsequent legal action they or their chosen third party DCA chooses to bring will be defended robustly and a claim for compensation will be made regarding the unlawful claims made by powerless.

hi i am looking for info on power2contact,they have issued me a card wich says to call them within 24hours,this is regarding a debt i have with united utilities,they say if i dont get in touch they will make a application for a warrant of entry from the courts wich will cost me more,i am a single mum on benefits looking for full time work and am worried please any help advive would be really helpfull x

P2C are getting above their station. Have you been corresponding with UU at all regarding the outstanding bill? That would be my first action regarding this, if you ring them then you should also follow this up with a letter to confirm anything they said on the phone.

DO NOT contact P2C by phone, EVER, they will simply lie and bully you.

I Have also just received a letter from theses people saying if I do not let them in my property it will result in an application for a warrant to enter my home. The thing is I had a visit at the beginning of December from Lowri Beck giving them access and they took the relevant readings. In January a threatening letter came from NPower saying I would be taken to magistrates court if they did not eneter my property, when I gave them the readings they said Lowri Beck had not passed on the information but the reading I gave them followed through from the previous reading and as far as I was concerned the matter was sorted. There is no telephone number on power2contacts letter for me to ring or e-mail address to contact them. I do not want them knocking on my door when my Daughter may be here on her own. I don't know what to do. can anybody help me get through to these idiots that they have or should have the information they require.

Firstly you need to make a complaint to themselves, start their complaints procedure and then you will be able to escalate it to the energy ombudsman sooner rather than later, if Powerless2CONtract do turn up then tell them to bog off, they have absolutely no legal rights to enter your property, not without a warrant, and even then I still wouldn't let them in.

I phoned NPower and told them to call Power2contact off and they assured me they had, this was yesterday lunchtime but today they called at my house when I was at work and my daughter phoned me up in floods of tears as he argued with her because she refused to let him in! I have now reported NPower (and implicated Power2contact as they are not on their list of companies) to the ombudsman. Watch this space.

Hi I am sorry but I am sure that Bazookaboo is somewhat in error.

I worked in the past for a similar organization to P2C and regularly obtained warrants of entry and went on to disconnect supplies or 'force fit' prepayment meters.

 

While I am on we did not 'kick down or damage doors' to gain entry and rarely changed locks.

 

I can see that some people have trouble paying their accounts however if they offer a payment which is lower than their consumption it is unlikely to be accepted.

On the more positive note attending court on the date of application for the warrant more often than not results in a deferral and negotiation.
