      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well that sounds about right.

 

OK people I really need some help from as many of you as possible please.

 

What I am looking for is as much information as possible from any cagger who has a bank account, loan or credit card agreement with these very nasty robots.

 

In particular I would be very grateful to anyone who had major problems with their account during the period January 2009 up to end of April 2009.

 

At this stated time Lloyds claim that they had a serious/fundamental internal system failure with their computer.

 

Have any of you caggers had a problem with your account (s) or your credit files as a result of this 'major system failure' within the Lloyds organization during those 4 months?

 

 

In fact, at any time in the last year, but I would be especially interested in to hear from those of you who had a problem with Lloyds TSB during those first four (4) months of 2009.

OK, comming back at you all now.

 

 

I was wondering if there is anyone of you super people out there who might be able to lend some much needed support for a very pleasant couple from the Stockport area.

 

I know many people on this superb site need as much help as possible, I wish I could reach out to you all at once and take your pain and suffering away from you in an instant, If I had that ability, then I would not hesitate to help you all.

 

This particular story about this very clean living and law abiding couple involves a Full and Final Settlement with the so very nasty Lloyds TSB, I am on the Full and Final part of this story for them and I am getting ready to give Lloyds a battle that they will never forget.

 

So, blimey, I just don't know how to say it, can any of you good people offer any kind of moral support or any sort of support for this couple, the husband is very unwell and his wife is having a very difficult time, they have already been steam rollered in court twice and the final decisive chapter is going to be written very soon, I am working almost round the clock on this story and I will not stop until I have finished with Lloyds and SCM Solicitors.

 

The woman is a new member on this site, she joined last week, so she is still learning and feeling her way around the place.

 

If I cannot stop Lloyds, is there anyone that could possibly go to the court with this wonderful couple, just to be with them so they would not be alone, if you think you might be able to help, then I beg you, please give them any help that you can.

 

This story is going to continue, get ready you bastard robots You are going to have to kill me first before you carry on with what you are doing to my fellow good people.

No worries. I have zero knowledge of the courts though, apart from a repossession hearing that Ell-Enn helped me win. :-D But Martin from CAG attended and it helped my family an awful lot.

I don't want rewarding or any monies. 3 months ago I turned to this site for help, and so far I have managed to wipe 5k of debt off for minimum effort. Just reclaiming charges, offering F&F settlements etc, You posts helped me a lot, the least I can do is return the favour.

thanks for your words of encouragement, the vixen robots now called, as do not like to even mention their name, have made my hubby ill over all this, a hearing, an adjournment we got, and next a trial, but have to pay £700 wasted costs because we asked for an adjournment, they are like a dog with a bone, even though in law they are wrong, we have been and spoken to about 7 solicitors on this, and all told us we are right,

did not even a final response but went like a steam roller straight to court with, lots going on still with this, so cannot say too much,

great website, only joined about 2 weeks ago, but been reading a long time, still finding my way around the site at present.

Have any of you had any problems relating to incorrect data being entered on your credit files by Lloyds tsb bank plc between January 2009 until May 2009?

 

If so, were you ever informed by Lloyds of this 'error' and that numerous customer accounts had been affected?

 

Have any of you checked your credit files this year to find that Lloyds have been making entries that you do not understand why they would be making this entry?

 

A lot of personal questions I know, but please understand, I am not looking for your personal info, I am investigating Lloyds and I am going after them ( legally that is) and SCM Solicitors.

 

Thank you in advance for any help you may be able to offer on this particular subject.
