Hello All,

 

My aunt bought a motor-home. Several months later, she gets a letter from an insolvency trustee saying that the motor-home was bought off someone made bankrupt in July 2008. They demanded information from the sale, invoice, receipt, bank details etc of payment!!

 

Can they ask for such information? I mean we're always supposed to be on our guard about giving out our bank details, let alone those of other people!!

 

She's declined to give them details of her "private to her" transaction, but I'm worried about her attitude and if they start threatening her with court etc..

Well you would be making their life easier if you did provide it but I wouldn't recommend doing so and the Bankruptcy Trustee can apply to the Court to have the Bankrupt and your aunt to appear before it in connection with any enquiry about the Bankrupt's property or dealings but it is NOT a trial. Technically, if the motor-home was owned by the Bankrupt on the date of the bankruptcy, it belongs to the Trustee, but if after that date, then it belongs to the Bankrupt but that is an over simplification of a very complex subject with numerous exceptions. I wouldn't worry too much about it and once there is something concrete then, if you can afford it, get some legal advice from a solicitor specialising in insolvency.
