UPS - Delivered goods to neighbour but now gone missing

Hi, Western Digital Corporation sent me a replacement hard drive (Value £50)

which was dispatched on 18th.

 

on 24/06/10 UPS (Delivery Company) tryed to deliver the goods to my address, but i was not in. UPS took the item to a next door neighbour who signed for the goods.

 

The next door neighbour admits he singed for it, however now claims he dont know where it is.

 

Western Digital said, they cant issue me another replacement as the goods where delivered to a neighbour. UPS are saying they are not liable due to terms of the contract allowing delievry to a neighbour.

 

So reported it to the police, who have givem me a crime reference number, but then said, no offence had been commited as the neighbour admits he singed for it, but cant locate it. so its not theft.

 

So i am now out of pocket.

 

The contract is beween me and WDC and not UPS

 

So, i cant sue UPS

 

WDC is based in the USA so i cant even sue them.

 

What are my options guys?

Update

 

Contacted the police, they came around and looked at the evidance i had and then went and spoke with next door. He admited signing for the parcle but does not know where it had gone.

 

The police gave him two options, (1) Be arrested and taken into custody or (2) sign a Police agreement to pay me £50.00 by 8th July.

 

Next door agreed and signed an agreement to pay me £50.00

 

 

Police said, if he dont pay by 8th, to contact the police and they will go and arrest him.

 

What a resault.

result EW, but the sender and their agent are of course wrong, the contract was to deliver back to you, the excuse delivered to a 3rd party without your consent is a red herring , and is so often used

..
