      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all you technical sorts.

 

Today the control board of a hard drive blew and I need to get some important data off it. It's only about 6GB of data so does anyone know if I can do it or whether it needs to go to a specialist.

 

If the latter, does anyone know what it's likely to cost me :(

If you're absolutely sure it's the controller board, and you're feeling brave, you could try some of the steps outlined HERE or HERE, or take it to a PC repair shop (who will almost certainly follow the same guidelines but charge you for the privilege).

 

You could also try the safer option of burning the latest Ubuntu to a CD, booting off it and seeing if you can see the hard drive from it (Linux is infinitely superior to Windows in its interaction with hard disks. I've saved many a file from a 'dead' drive simply by accessing it with Ubuntu).

 

Assuming it's not the controller but the drive itself, and Ubuntu can't see the data, a last ditch attempt could lie in freezing the drive. Sometimes, drives die because certain compoents - usually the drive arm that holds the reading head - gets jammed, so the disk can't read any data from the platter. The idea is that putting the hard drive in a sealed bag (to prevent moisture) and placing it in a freezer for at least 24 hours, shrinks the components sufficiently enough to free the drive arm and allow the hard disk to function again until the nature heat of the PC and activity causes it to jam again. I've only managed to get this to work once, with a 48hr freeze giving me a little under 20 minutes to grab the vital data, but this really is a last-ditch attempt that should only be tried with an otherwise totally dead drive.

It is definitely the PCB. I was trying to get the info from the hard drive as the PC it originally came from has died so I had the hard drive lying loose inside my PC case and when I switched the PC on the was a bright flash, lots of smoke and one of the chips on the PCB burning away quite merrily.

 

I will try the repair first. Shouldn't be too hard to get a control board for it

gonna be tough finding a controller board for a hard drive with the exact same number of cylinders/heads/sectors... good luck, maybe try the 2 week trial of consumer sniper for ebay!

Straight pcb swaps arnt that hard, the tricky bit is finding identical hd, although there are lots on ebay, sometimes faulty ones you can pick up cheaply.

 

Professional hd recovery is very expensive, in the high hundreds !

it's a Maxtor diamondmax 10, 300GB SATA150 (1.5GB transfer rate)

 

The numbers on the cirduit board are

 

MAEXEYAE R6GBA 07015LCJHM (whatever that means)

 

There is also this number printed on the board

 

301931102

Diamondmax 10 model 6L300s0 300 gb sata150

 

I also have the stardrive for removal of logic board.

Just an update to this.

 

After reading up on various websites about what I should look for regarding the logic board. I bought a hard drive from ebay. The logic board had all the same codes as my original but when I swapped them over, the old drive started knocking so something is either wrong with the new board or something else wrong with the HDD. I did test out the new HDD and it is fine.

At least I now have another HDD which I will stick in my PC

I'd say if the drive has the same number of sectors/heads/cylinders and made by the same people then it's not just the controller board that is fried :(

 

 

I can't see anything about that on the drives.

I'm doing a search for data recovery specialists and what they are likely to charge.

The thing is, the data is not that urgent( to me anyway) All that I need to do is get some photo's and a few chapters of a booklet my ex was doing for her partner who died a couple of years ago. About 5GB of data and 90% of that is the pictures
