Hey there,

 

I asked First Credit for my credit agreement a few years ago and they responded months later with the copy of the Credit card application form and a seperate sheet with T&C's. I thought it was rubbish, so I never paid up (they had started to bully me on the phone so I stopped paying when I asked for the credit agreement). I subsequently went travelling for a year and never bothered about them. A few days ago I got a letter offereing me a discount of 60%. They say they can offer me a settlement of just over £1000. Now, I am on jobseekers as I have returned from Australia and all I have is around £700 or £800.

 

Do you think I should write to them and offer them this or will they take it as cheeky and remove the offer for discount????:confused:

Why pay an alleged debt that they have yet to prove is enforceable? If they couldn't produce a fully executed agreement then it's highly unlikely that they will now or in the future, besides it becomes Statute Barred after six years (five in Scotland) if no payment or written admission has been made in that period & all defaults are expunged from your credit file six years from the default. ;)

That's another thing in your favour because it is extremely difficult for them to take enforcement there in any case. ;)

 

You could write and make a full and final offer on the proviso that they remove all adverse information on your credit file. If they have bought this debt (which is more than likely) they will have paid between 7 & 15% of its value, so if you allegedly owe them £1K start off with an offer of around 20% = £200 & see what their response is. ;)

Theres no guarantee they WILL remove any adverse info-they may merely mark as "settled"

Personally I would NEVER offer this murky lot one penny - they ONLY get a cent if the judge says so - otherwise it's bye bye!

 

They appear to be expert at buying alleged debts that other DCA's and banks have chucked out as a TOTAL waste of time...

 

So why pay them?

 

I believe its also only a question of time before they have their credit licence taken away by OFT..

 

Just wait and see!

I agree with Cerberus offer £200, tell them your on benefits

it's all you've got take it or leave they'll get less if they take you to

court.
