I will do as you suggest. Thank you. Mind you that was what I did the previous year when they were going to raise my payments I was ready to leave and they fixed the price for another year. And this January they did the same and also mentioned that they would be a slight increase in March but that would not affect me. That was why I ignored their letter to say they were increasing the tarrif because I did not imagine that they would be trying telling me to ignore and only afterwards actually increase the price on me... then when I point that out they say I did not call to cancel and complain and hence I am bound by their terms and conditions. I told them I will fight them to my death and take them to court about it if I must. -

I've just checked on MCOL and there's no recent updates after I filed the defence weeks ago. No idea how they got my email, but just sent an email to DCB to ask them to stop sending stuff to my email. So thanks dx. -
Thank you. What % do you think we should start with for cap1? 20%? We've also received the CCA for a couple of the MBNA debts that now sit with link financial. Please see attached. The one for my Mum seems very lightweight compared to the one for my Dad... Are these correct? If not, what should we do? I guess if they are valid this changes the strategy similar to cap1 - pay monthly sum again and try and agree a F&F settlement offer? MBNA-CCA-Mum.pdf MBNA_CCA_Dad.pdf

Be very careful of a simple naming error ...dont assume anything. Read it as 'this car park' D entered and exited an anpr system ..there is evidence of that. oh and those signs..look at the word spacing can't be parking not enough letters. its a std risk assessment sign to protect the public from potential danger. Nothing to do with cel at all .... Dx

Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
So I issued the claim on day 15 and they requested more time to respond.
They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
I opted for mediation, and it played out very similarly to other people's experiences.
In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them.
In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.
