    • Thank you. The npower debt was from 2019/2020 until EON took over the account late 2021. npower had set a DCA on me even though I owed them nothing. I spoke to a customer service agent, following up by email, who confirmed I was in credit . I made a complaint to head office who sent a barrage of emails, changing the amounts each time. According to them, I owed £279. The debt grew to what it is now as first npower and then EON subsequently failed to put a payment arrangement and direct debit in place to pay off this supposed sum and my ongoing bills. I was very ill with Covid, struggling in lockdown with a disabled child and informed them of all this. EON stopped their legal action when I took them to the ombudsman as this was part of my complaint and requested remedy but I have not received a notice of discontinuance.  I would like to set up my own dd to pay them off but am concerned they could still take legal action. I am on a low income and can’t afford to pay them more than a token amount each month.  And yes, they state their client is EON and that they can return the debt to EON who can either register a default or take me to court.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

well well well, how the tables haev turned for the banking giants.

 

I have still not heard a word from the halicrap on my ppi claim - what type of l;etter should i be sending them...... I have paid off my card, although when I log on online it tells me I am in arrears!!! what a hoot!!!

 

any advice as always is gratefully appreciated.

no, it hasnt got that far yet, I wrote to them twice and they wrote back stating that as the process was under review they were not responding to my claim. I have still heard nothing. when I made a claim against my other halicrap account they refused to pay me the 8% stat int that I was due and got less than 25% of what I was owed.

is it not too late to try to get back any money if they consider it settled?

 

How did they pay the money back?

Did they say it was a full and final settlement?

Did you say accept it as F&F or did you tell them it wasn't enough?

 

I tend to agree with dx that you should pursue them for the rest of it, but you might need to explain your acceptance of a part payment, especially if they described it as F&F.

 

Do you have the letter telling you about the payment. If so can you either scan it removing personal info or post up what it said, and also any reply you sent (if you did).

hello world, and all who ever read my thread, well the update is simple, I have had some money back and despite writing to FOS I have only received a few pounds back from halicrap, the only upside is that I am within £300 of paying off the biggest of my two debts while the smaller debt was cleared.

 

This was not one of the easiest things of my life and two years down the line I am still fighting to get money back. It seems that the Halifax just dont want to listen to reason.

 

i would urge anyone who has the ever read my thread to never give up, these institutions can be barbaric in their approach to ordinary everyday hardworking people who in fact only ever want to pay back what they owe.

 

until such time, me and the halifax will argue. after checking my credit cards accounts on line this morning, it would seem that despite one account being cleared for the last 6 months they still tell me that I am in arrears! how stupid bonkers is that! who do I speak to in order to get that settled?

Still here but don't spend as much time on here as I used to, there are still a lot of very helpful people around but sadly a lot of the older names have gone for whatever reasons.

 

Glad to hear you are coping and reducing your debt but you are right in trying to get the incorrect information amended. I suppose you should approach the original owners of the debt first and see what explanation they give as to why the balance is still showing.

hello A little update on this debt..

 

 

So I stopped paying this debt, years ago, no CCA could be provided etc, so I stopped paying.

 

 

The debt no longer appears on my credit file, and although I still owe £190

I get the occasional letter from Lowell who is the latest DCA.

 

 

I have now had a letter from BPO collections offering a 41% discount!!

 

 

I am minded to do nothing, but am concerned that this debt will reappear on my credit file. I

 

 

am recently separated and paying the mortgage etc myself.

At some point in the future I want to remortgage the house to take my ex name off the mortgage etc

and don't want to do anything that might cause an issue.

 

 

 

 

...Any advice on steps would be appreciated Thank you

Hi feely. It's been a while. Seems like you've had some changes in your life. Hope things are improving for you.

 

I agree with theoldrouge. Ignore it. You don't want to start engaging with them. The debt can't be defaulted again so don't worry about any future mortgage application. They're just phishing and hoping you'll fall for it. ;)

Just saw this thread, urge you to keep a check in the interest rates. The more you pay the more interest they will try to lobb onto your overall debt. Be careful, even if you make the regular agreed payments keep a running excel account of each balance to see if it is getting reduced.
