    • In terms of "why didn't I make a claim" - well, that has to be understood in the context of the long-standing legal battle and all its permuations with the shark. In essence there was a repo and probable fire sale of the leasehold property - which would have led to me initiating the complaint/ claim v SPF in summer 19. But there was no quick sale. And battle commenced and it ain't done yet 5y later. A potential sale morphed into trying to do a debt deal and then into a full blown battle heading to trial - based on the shark deliberately racking up costs just so the ceo can keep the property for himself.  Along the way they have launched claims in 4 different counties -v- me - trying to get a backdoor B. (Haven't yet succeeded) Simultaneously I got dragged into a contentious forfeiture claim and then into a lease extension debacle - both of which lasted 3y. (I have an association with the freeholders and handled all that legal stuff too) I had some (friend paid for) legal support to begin with.  But mostly I have handled every thing alone.  The sheer weight of all the different cases has been pretty overwhelming. And tedious.  I'm battling an aggressive financial shark that has investors giving them 00s of millions. They've employed teams of expensive lawyers and barristers. And also got juniors doing the boring menial tasks. And, of course, in text book style they've delayed issues on purpose and then sent 000's of docs to read at the 11th hour. Which I not only boringly did read,  but also simultaneously filed for ease of reference later - which has come in very handy in speeding up collating legal bundles and being able to find evidence quickly.  It's also how I found out the damning stuff I could use -v- them.  Bottom line - I haven't really had a moment to breath for 5y. I've had to write a statement recently. And asked a clinic for advice. One of the volunteers asked how I got into this situation.  Which prompted me to say it all started when I got bad advice from a broker. Which kick-started me in to thinking I really should look into making some kind of formal complaint -v- the broker.  Which is where I am now.  Extenuating circumstances as to why I'm complaining so late.  But hopefully still in time ??

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

How about something like:-

 

Further to your letter dated XXXX where you admit the misselling of PPI on the above mentioned account,

To assist your 'team' in concluding this matter,

I have enclosed a schedule of charges you have levied and the interest costs related to them.

I expect the payment BY CHEQUE, to be forwarded to me within the next 14 days.

If I have not received the payment owing after the 14 day period, I shall submit a claim via the Court for payment.

You should be aware that if I have to take this course of action, additional costs will apply.

ok - that looks good to me - problem is that they wont refund the money to be directly they said they will set it off against the outstanding balance on the account?

 

Is that correct - and can they do that?

This is YOUR money that they are paying back, and it's up to YOU to decide how you want to spend it. They cannot just help themselves to it to pay off a debt with them. Tell them that the account is in dispute anyway owing to the charges which you will be claiming back, and tell them in what form you want the refund, whether by cheque or into your bank account.

 

If you have more pressing priority debts then you could use the money for those.

 

If you're happy for it to be used as they suggest, then fair enough, but you must take control of this.

I would very much prefer to have the money back, but to be fair then I would rather see the back of this account so I know what I ought to do.

 

I will be sending them a letter today as suggested yesterday with my calcs.

 

I am not sure what the process is regarding claiming back my charges - can anyone advise any further on this one? I suspect that I need to take one step at a time and sort the PPI out first?

thought you'edalready done the charges SOC before the PPI?

 

anyhow same spreadsheet/process just charge them at the int rate [cash or purchase] from you statment & leave the 8% off till/if you file for court.

No, I have not made any claim, I queried the PPI when I wrote and also disputed the balance, I then got various letters and finally one last week confirming that i had been misold the PPI and they were referring it to the redress team for recharge back to my account.

 

To reclaim the charges do I write to them enclosing my calc sheet and state that I am disputing the charges on the basis that they are unfair?

I am sorry, I am going through this with some valuable help, I wouldnt know where to go if it wasnt for some of the help that I have had so far, this keeps me awake at night. dx you are clearly a very knowledgeable person and I am grateful.

I am updating my thread for anyone reading, I have sent my letter stating how much I consider I am owed due to mis-sold PPI and have attached my calculation sheet. I am sitting back now and waiting for a response. Have also sent a LBA regarding the missing informtion from my SAR. Will keep my thread updated as an when anything new arrives. Next step will be to claim back my charges (taking one step at a time).

Let's hope they don't take too long feely. I'd give them a week or 2 and then a reminder with a time limit or you'll take further action.

I am hopping steaming mad, the halifax have written back to me (letter received today) and they have basically informed me that they are refunding me the following: They have totalled the PPI that has been charged to the account and a whopping £2.73 interest! They have said that is all I am entitled to! I am not sure why the interest is £2.73? how do they work that out?????? In addition they have said that if I am unhappy with their response I need to write to the FOS within 6 months of the date of their Final Response Letter!!! never had a letter entitled 'Final Response Letter'.

 

And lastly, they have duly nformed me in the same letter that as my credit card account had a default notice on it (yet to be proved to be valid) and / or the full balance is due all of the monies owed WILL be rrefunded to the account and NO CASH payment will be made!!!

 

advice would be most gratefully received as I thought they had to pay me compounded interest since the date the PPI was added, which amounts to over £250 and not the £2.73 they have offered me!

 

Makes me very annoyed, have a good mind to just go for court action (but thats another learning curve).

This is your first offer FDAO and this will always be the lowest they will try and get away with, you now have to write back and demand how they have calculated their figure and you will probably get an increased offer.

 

How much have they offered, against what you requested? Keep figures approximate.

 

Don't let them wind you up, stay calm and take a few deep breaths!

hi dotty, they have offered £330 against £570 which is arguably more than 50% I know.

 

ok so will write to them tomorrow asking how they work out the offer they made - do I state in my letter that I am not accepting the offer they made me?
