There's a hell of a lot going on the enormity of the abuse of this CRA/DCA system is now just becoming clear.

MH paid out and agreed to no longer process any data on me!!:-o

Lowell have not been cooperative nor have Equifax so am waiting final responses, Court claims for costs and damages are on my desk ready for issue.

Iv'e started to compile any data on this, and am determined to go all the way through the courts if I have to:evil:

Hi, once Iv'e collated and copied the reports sent in by the Caggers, the whole lot is going to OFT,ICO, and FOS.

I hope to get a fairly quick response from my MP.

Right. I got my cheque from Mackenzie Hall and paid for a well deserved holiday out of it.

 

Now Equifax on the other hand have only apologised and offered me a 30 day free trial and now i cant seem to find the letter. I have my letter which i sent to them asking for compensation. What do i do next?

Hahaha, I have just rang Equifax and the woman on the phone told me that these Table 1 searches are allowed :lol:.

 

Stupid woman, if it was allowed we would not be getting them taken off and compensation!!!!!

Unfortunately Equifax are a hard nut to crack,but try a letter to Janice Rudd giving the details of your complaint,I ve just been through this an got a garbled explanation, but refusing compo, although it's from a Kathryn Keogh

Customer relations manager.

So I written again pointing out the damage done etc, and sent it RD as a letter before action.

Equifax a nightmare to talk to I some times wonder if the call centre is in Bombay not Bradford, they insist on putting on to some superannuated school boy calleg a line manager.

 

Congrats on the cheque. KEEP FIGHTING>all info sent RD to MP 0900 TODAY.

To add a little more to the saga just had a letter from ICO ref: letter I sent 13/09/10.

The interesting bit is :

 

''In view of the information provided, we have transferred your cases (MH,Lowell, Equifax) to a specialist team in our

Complaints Resolution Division, this team deals with case that require more detailed consideration.The companies

have 80 days to comply with the ICO's questions and findings.

Right ive got an update. I have asked Equifax for compensation but they have sent me a letter asking for my cost in detail and supporting statement. They also want me to detail the reasons why i believe the loss was a result of error on equifax's part.

 

Any chance of some help on this?

Equifax is the most uncommunicative companies simple correspondence is not answered often for weeks.or just ignored.

They have allowed searches by a DCA to be placed on your file on table 1 which is for searches undertaken in connection with CREDIT APPLICATIONS, DCA's DO NOT GIVE CREDIT,NB they now allow DCA's to place searches as if they are credit card providers or loan companies.

You need to make a complaint to the ICO,OFT and Trading Standards.

Equifax has been ignoring me since Mackenzie Hall paid up saying the searches are inappropriate.

 

I am not giving up you must persevere with the complaints.,

Do send them details of what this has cost you, time,financial loss, costs for the credit searches etc.

Include an amount for the embarrassment and inconvenience of being rejected for credit about £100- £150 per search.

State that this is your final response before issuing a County Court Claim for damages and costs which will increase

their costs considerably.

 

I have my MP asking questions about this.

MH paid up,Lowell have ceased to answer letter as do Equifax, so I've gone to the FOS

who are n the Equfax case now.

 

The ICO has put a specialist investigation team on to the have 80 days (About 60) left.

I also put 1ST credit Connaught LCS and Priestley under investigation by the SRA so been quite busy.

Keep up the good work Brig, i shall be commencing battle with MH very soon for multiple table one searches and by the sound of it they cave in without to much trouble.

The Brig hasn't been gagged just major neurosurgery on spine and loss of feeling in

hands.can't hold a pen or type to well yet.

All the searches have been removed from CRA's

I have also had a number of searches on my previous and current address in table 1 by Mucky Hall at the end of March. I have written to Compliance Manager as per advice and also Trading Standards. Mucky Hall have also got hold of my current landline number, which is not listed anywhere, and have left a number of automated messages.

 

They have also been calling the number of a previous address, which I left over 11 years ago. Called Mucky Hall today and laid down the law with them. The poor guy on the end of the phone was a little tongue tied to say the least and didn't say a word out of place. It seems that if you know what you are talking they don't argue back!

 

I am looking forward to their response!!!!

Hi Jassey,

I would fire off a RD letter to Rob Sands at MH lay down the law in succinct and positive manner that any further

call will result in action for harassment, from your post it seems to me that the debt they are chasing may

well be statute barred.

Please pot up the details of the matter they are chasing so the guys can advise further if you have any letters from them

post up after removing all personal data and bar codes to give us some idea which way to go.

Sorry, I should have explained a little better, I know the debt is definitely SB as its from 1999 and have also sent a letter informing them of this. The guy at Mucky Hall confirmed that the account was 'on hold' as they had received my letter, but he couldn't explain why calls were still being made today!

 

I also sent a letter to Mr Robert Sands, as per your excellent advice from previous posts, informing him that credit searches in table 1 were inappropriate and should be removed.

If they continue to try it on a further complaint to the OFT and Kilmarnock Trading Standards

might be a good idea.

I would send a letter stating again that the debt is stat barred and no payment or offer of payment will be made

and refer them to the OFT Guidance on Stat barred debt.

It is unfair to pursue a debt when the debtor has stated it is statute barred and they will not make any payment.

They can still write threatograms and posture that the debt still exists but there is sweet FA they can do!!!:madgrin:
