    • Thanks for posting the CPR contents. i do wish you hadn't blanked out the dates and times since at times they can be relevant . Can you please repost including times and dates. They say that they sent a copy of  the original  PCN that they sent to the Hirer  along with your hire agreement documents. Did you receive them and if so can you please upload the original PCN without erasing dates and times. If they did include  all the paperwork they said, then that PCN is pretty near compliant except for their error with the discount time. In the Act it isn't actually specified but to offer a discount for 14 days from the OFFENCE is a joke. the offence occurred probably a couple of months prior to you receiving your Notice to Hirer.  Also the words in parentheses n the Act have been missed off. Section 14 [5][c] (c)warn the hirer that if, after the period of 21 days beginning with the day after that on which the notice to hirer is given, the amount of unpaid parking charges referred to in the notice to keeper under paragraph 8(2)(f) or 9(2)(f) (as the case may be) has not been paid in full, the creditor will (if any applicable requirements are met) have the right to recover from the hirer so much of that amount as remains unpaid; Though it states "if any applicable ...." as opposed to "if all applicable......" in Section 8 or 9. Maybe the Site could explain what the difference between the two terms mean if there is a difference. Also on your claim form they keeper referring to you as the driver or the keeper.  You are the Hirer and only the Hirer is responsible for the charge EVEN IF THEY WEREN'T THE DRIVER. So they cannot pursue the driver and nowhere in the Hirer section of the Act is the hirer ever named as the keeper so NPC are pursuing the wrong person.

    • Good afternoon, I am writing because I am very frustrated. I received a parking fine from MET Parking Services Ltd , ( Southgate park Stansted CM24 1PY) . We stopped for a quick meal in Mcdonalds and were there fir around 30 mins. We always do this after flights and never received a parking fine before.  Reason: The vehicle left in Southgate car park without payment made for parking and the occupants southgate premises. they took some pictures of us leaving the car. i did not try and appeal it yet as I came across many forums that this is a scam and I should leave it. But I keep getting threatening letters.  Incident happened : 23/10/2023 I did contact Mcdonalds and they said this:  Joylyn (McDonald’s Customer Services) 5 Apr 2024, 12:05 BST Dear Laura, Thank you for contacting McDonald’s Customer Services. I’m sorry to hear that you have received a Parking Charge Notice following your visit to our Stansted restaurant.   We've introduced parking restrictions at some of our restaurants to make sure there are always parking spaces available for customers.   We appreciate that some visits such as birthday parties or large group visits might take longer and the parking restrictions aren't intended to stop this. If you think your stay will exceed the stated maximum parking time then please speak to a manager in advance.   Your number plate is scanned by our Automatic Number Plate Recognition (ANPR) system when you enter our car park, and then again when you leave. If you have overstayed the maximum time allowed, you will not be notified straight away- a Parking Charge Notice will be sent to you via the post.   If you feel that a Parking Charge Notice has been issued in error, please contact our approved contractors who issued the charge in order to appeal the charge. Unfortunately McDonald's are unable to revoke parking tickets- the outcome of the appeal is final and cannot be overturned by McDonald’s.   Many thanks for taking the time to contact McDonald’s Customer Services.   Can someone please help me out and suggest what I should do next?  Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I would still like an answer to a very simple question:

 

If buses, taxis, cycles & motorbikes can go down this ?100 yard section of road with impunity, how would it compromise the flow of traffic in Greater London if cars, vans & lorries could do so too?

The one way system is designed to route the thru traffic away from the town centre, Eden street has hundreds of buses a day stop in it and the road could not cope with thru traffic from Surbiton and Esher its just not wide enough.

If you allowed traffic to use the start of Eden St what would be the point they would have to go around the mini roundabout and come back the same way or end up using the section that is used by almost every bus that serves kingston.

The benefit would be not having a hideous clutter of signs and ineffective painting on the road. Less cost to ratepayers to install & maintain these & cameras, reduced costs to ratepayers for Guildhall staff to process (ineffectively) these controls. A reduction in controls imposed on citizens without their request or consent.

 

At least people could drive round in circles in freedom. I am old enough to remember when this was a free country.

Attitude?? You said you was old enough to remember when this was a 'free country' I assumed you were refering to traffic law? The first speeding ticket was issued in 1896, the first Traffic Wardens arrived in 1960, just how old are you? You may think the signage is not clear that is your opinion but trying to argue you should be free to use Eden street as a short cut and hold up one of the twenty bus routes that use Eden street in each direction just because its a 'free country' just goes to show it is maybe not me that has an attitude problem.

Except that the council has raked in almost a million re this bus lane alone! In any case, aside from this Last of the Summer Wine type discussion, one member has already asked for the authorisation and correspondence between DfT and Council so as to fight the current PCN's.

People will ignore signs however correct they are you only have to stand at the junction for a few minutes on a Saturday to watch people turning left into Union st despite the two 'no left turn' signs, no left turn on the road and a built out kerb. A lot of the vehicles that 'use' the bus lane turn into it from Union St and St James st ignoring the no left/right turn signs so its not just drivers that arrive from the High St and get 'confused'.

Has anyone ever stopped to count the actual number of signs at this junction and on its approach? As the adjudicator implied, rather a lot to digest! I, too, have seen people turn left into Union Street - how they manage, I don't know and the capstans/obstacles often get scraped in the process. Or whatever they are called! They look like quince-shaped bells! Pardon my poetic licence! The problem is, unless you know Kingston, you don't know how to access Eden Street car park, whch is why people panic by either attempting to turn left - I wonder whether the council penalises these people? - or driving up the bus lane to turn round to access it instead of finding the unknown routes which take you there.

 

The only route I know travelling from the Portsmouth Road heading towards Kingston is to turn right at Jamie's Italian into Kingston Hall Road, and then immediately left at the lights into St James's Road past the County Court. This then takes you to the junction and the entrance for the car park is straight on i.e. across the junction. Remarkably, this is the only direct route aside from another one which involves a few more manoeuvres which the stranger to Kingston wouldn't possible know in advance i.e. right at Nandos into East Street and first left into The Bittoms and then immediate right into Kingston Hall Road etc.

 

The only other route coming from this direction is to use the Penrhyn Road, avoiding the Bus Lanes, turn left at the College Roundabout and go down Kingston Hall Road and come back on yourself - easier said than done as the mini roundabout at the bottom is not easy to negotiate doing a 360 complete turn. Unless you have a Hackney cab!

Hello everyone! I am new here...and have a problem! :(

 

I have just come back from holiday to find I have been issued a PCN for Being in a Bus Lane...

 

Eden Street : Eastbound between the junction with Union St/St James Rd!!

 

What's upset me is that I honestly had no idea I was in the wrong; I go to university at Kingston but rarely drive; I was simply picking up some furniture for a friend, and got incredibly confused about my surroundings! I don't even remember driving into a bus lane (I follow rules to a T)

 

I can't remember if it was when I was confused trying to find the car park, or just as confused trying to get back home...I think I may have to bite the bullet and pay the reduced fine (£65!!! :/ )

 

I would like to challenge, but at the end of the day...I drove in the bus lane :/ There's photos and everything...I feel sick with disappointment! :(

I have just received a pcn (my first ever motoring fine in 45 years!). It was for being in a bus lane in Eden Street:Eastbound between the junction with Union St/St James Rd & the junction with Brook St.

 

This was my first ever visit to Kingston and I got hopelessly lost looking for a car park. I have never been in such a confusing city centre. I had no idea that I was in a bus lane. I have read through a lot of the previous threads but because of all the changes is it still possible for me to appeal on any grounds or do I just grin and bear it. I will certainly never visit Kingston again.

There have been several threads on these Bus lanes but all the OPs seem to disapear after taking the advice given. I'm trying to escalate the matter to stop enforcement and need to hear from anyone that has a PCN issued in Eden Street Kingston regardless of the current state ie cancelled, paid, outstanding.

 

I am new into London and stated driving recently. Today I received a PCN for being n a bus lane in Eden street : east bound between the junction with union st/st James rd and the junction with brook street (24 hours). It s o shocking since I was looking for parking and mistakenly entered the lane. Just wanted to confirm is there any hope of the PCN cancellation if I appeal against it?? :(( need urgent help !!

Your circumstances are exactly the same as mine. I have written a letter of appeal and am currently awaiting the result. I will keep you posted

I sent off my letter of appeal on 8th October and it was signed for on 9th October. I rang today as I had heard nothing from them. I was informed that it had been received but that there was a 4-5 week back log in dealing with it. Dread to think how many PCN's they must be issuing

Well, here is another! Received it yesterday. Drove over there this morning, and correct if I am wrong, but I did NOT see a 'right turn only' sign as I approached the junction. For obvious reasons, to me, there should be one and is it legislative fact? The right turn arrow on the road is easily obscured by on coming traffic from Eden Street east. I certainly did not see it, but then I was otherwise 'engaged,'

 

 

My instance - after the event and after I got the PCN - was that I was distracted by two police horses coming out of Union Street and immediately turning left. I suspect they can do that - can they? I waited for them and simply followed them not knowing I was entering a 'bus lane' as they did. I continued slowly following them. Half way down the street the outrider waved me through. I pulled out and drove down to the roundabout for a right turn. In other words I had not taken in the fact that it was one way only! I discovered it when I got the PCN!! However, the video that I have viewed shows the mounted WPC waving me through to enter the one way. Were police aiding an abetting??

 

 

Anyway I am going to appeal in the strongest of terms. The town of Kingston is a traffic nightmare and it is of no help to know that the Council are taking advantage of their own shortcomings to fleece drivers.
