    • Correct but wont stop them chasing you though even if no payment for  6 years (statute Barred) Some DCA s buy debts (the debt is assigned to them) and some do issue court claims ...just so you are aware.   Andy
    • Thats because this claim has not been allocated as yet hence the above hearing *Case Management " to determine the directions (N157 Notice of allocation) which will follow after this hearing. You are not requested to submit a statement but have all the details with you (claim form defence CPR CCA etc etc)   Andy
    • Our price is the same all day, but varies day to day. Yes there's a risk of high prices but it has never gone above SVR any time since I signed up. Last 30 days average 17.67p/kWh, max 20.67 and lowest was 11.83.  It saved just under £300 during 2023.  
    • It you had E7 in the past but have converted to single rate then the meter will still hold the last recorded Night readings. This introduces scope for error when manually reading. If the meter has only ever been used on single rate then there's only one figure that can be taken. For example ours shows "Rate 1" reading and a "Total import" reading, but they both give the sme figure. If it has ever been on E7 the total will be higher, including the retained night reading.
    • okay, perfect and thank you so much for the help once again. so firstly i am going to initiate the breathing space, during this time it's likely ill receive a default. when i receive the default are you aware of how long it will take for me to know whether the OC have sold it off to DCAs? Once it's with the DCAs i do not need to worry as they cannot issue a CCJ only the OCs can Even if i decide to come an arrangement with the DCAs no point as the default will remain for 6 years paid or not paid I should only consider repayment if the OC still won the debt and then issue a CCJ? Just to confirm the default will not be seen after 6 years? No one can tell I had one then after 6 years ill be all good?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Having sent a DPA letter to First Direct on 13/03/06 requesting my statemants and any notes on my account, I got a reply from them which was sent on the 14/03/06 saying that they would send my statements , reference book notes, and martini notes to me by courier. This mornig I received these by courier at no cost to myself for the statements or delivery. I will read everything that I have received and get back to you. I may need some help. :?:

sent LBA letter on 19/04/06, received a reply yesterday from Marcus Golby (head of service delivery and change) saying that they don't agree with my contention about the charges etc etc.

 

goes on to state: However I am obliged to advise you of your right to refer your complaint to the Financial Ombudsman Service, as this letter constitutes the Banks final response.

 

What to do next?

Ignore their answer, and go on to step 2: Letter before Action. You're doing fine.

 

Your claim, your deadlines. Don't let them lead you astray.

Hi

im new here so taking all this in at the moment

I sent a letter to First Direct about my bank charges and was told there was nothing they could do i should have read there "terms" and there was no way they would refund any of the charges on my account........do i carry on?

money claim filed 31/05/2006

court date 8th September 2pm

offered full refund 1st Sep

Having First Sent D.p.a Letter On 13/03/06, Next Letter Was Request For Repayment Of Charges On 27/03/06 And The Last Letter Was Letter Before Action Sent On 19/04/06. The 14 Day Time Limit Is Up And Should I Therefore Start Court Proceedings And If So Is There A Template That I Can Use To Fill And Send Over The Internet

LOL, read the FAQ and the template library. Yes, there is kind of a template.

 

Good luck, I filed my claim on Thursday night (it was issued on Friday morning as the courts deal with things received before 9am on the same day).

 

i.e you file it online at 8pm monday night, it gets dealt with on Tuesday morning. You file at 7am tuesday morning, it gets dealt with Tuesday morning. You file at 11am Tuesday morning, it gets dealt with Wednesday morning, get it?

Received Notice Of Issue From The Courts To First Direct Yesterday 24/05/06 And Notice That Acknowledgment Of Service Had Been Filed From Dg Solicitors Today And That They Intend To Defend All Of The Claim.

Almost immediately (i.e the same day or within a few days). After the acknowledgement you'll most probably receive an offer of settlement in full within 5 days or so (max).

should I sign and return the form crossing out the confidential bit or would this jepordise my settlement?

 

Don't think anyone else has had any problems with crossing out the confidentiality bit... Some have advocated suggesting confidentiality would require a seperate contract at a premium...
