here goes, I never had a problem with debt, I could get any car/credit/loan I wanted, companies kept giving me credit which i took as i could afford-now 3years later after getting my own house and 2 kids under 2yrs i fell behind with all creditors. kept ignoring letters for payments as i dont have the money. long story short i have 3 ccjs which two they have charged on my property and aload of defaults. I dont know what to do, we tried for a iva which they agreed with and we paid admin fees then the iva company said payments will after be 600 a month till i go back to work, we cant afford this so they put onto a debt management plan within same company but its a waste of time-still getting harrassed from creditors,baliffs. they take so much admin fee an interest on charging order loans are getting higher and higher. we have about 40k debt. i dont want to loose our home. please could some1 help... thankyou i am 26yrs old

Never pay someone to admin your debts as there are registered charitiess out there who will do it for free like the CCCS. They will simply ask you to provide details of your outgoings and income. They will negotiate with the companies and agree a suitable repayment plan which will cost you nothing.

With regards to the CCJ's those debts have to have priorty and you would need to talk to a counsellor at the CCCS about those.

My suggestion would then be as follows:

Break down the debts into catergories as you will need advice off different people if they are in different finance sectors. i.e. Loans, credit cards, HP.

Write down the debts you have on here and you will receive good advice on sorting your problems out.

Start with one section say credit cards, list them, and when they were taken out, you will then be advised to send a CCA request to each one asking for a copy of your original consumer credit agreeement. You will find the template letter on here which you need to send enclosing a fee of £1.

You do have the legal right to challenge any debts which are not accompanied by a properly executed agreeement. However the CCCS will not be prepared to support you once any of the accounts they are administering for you are in dispute, but whilst the CCCS are looking after your debts usually they will leave you alone. I think that swapping over to the CCCS will buy you some time and save you from being charged for something they will do for free.

thanks for your replies, 1 loan was taken out 6th july 2006 but others were after. 1 ccj is for a hp but i no longer have the car as it was written off and insurance wouldnt pay out. where do i put my threads for my debts? sorry to sound thick ha
