    • Totally stupid mistake struggling with money with 2 young kids no excuses so I won't bother justifying  just feeling deep regret and absolute fear for what happens next. Sincere moments of madness opportunistic and absolutely stupid Caught shoplifting from sainburies by and shop lifting plain clothed detective (penut butter almond milk chia seeds and nuts ) I only took 3 to 4 items from sainbries listed above  First time I did it In saisburies i have never done it before   Was given a letter banning me took details but no photo taken  I also had on me food items from mns that the store detianed at the same time as they wouldn't let me leave without showing a receipt as they said I would have stole those too (they werent wrong) . I have been to mns a few times in the last month and done a similar thing always general food shop  So I left the sainbries store when he let me go and left all the goods there mns.and sainsburies and did not return.  M&s and sainsbries are on the same high street   Questions  Was not caught by m&s will sainsburies share my info and will m&s be in touch? Presume they can check cctv of the time sainsburies detained me and probably find it  No police called when at sainburies  Scared that mns will also ban me after the event  or worse check cctv and have my details and pass to police to investigate  I am mortified at what I've done the detective did not mention anything about further letters / police or anything more other than taking my details and giving me a banning letter  My fear is they have told MNS and now MNS will investigate aswell they may have their own footage etc...and go further than sainsburies did at that time  Mns goods was fruit veg chicken cheese basically all food items  Advise please what could I be facing 😭

Lol.    you seem very knowledgable.    argos’s current stance was that yes it was paid for at distance and not in a physical store and I couldn’t inspect before purchase, but had the opportunity to ask to do so when collecting.    not to anger you, and I’m sure you’re right….   you’ve seen a few of these before, and paying and then collecting in store would absolutely still qualify as a distance sale and be subject to the distance selling rules.    thank you for your help. I really appreciate it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just noticed on their offer for my account they have not included the £100 allocation questionnaire fee so a slight change of plan I think

 

Accepting the offer on the joint account , but as for my account I am sending them MY OFFER tomorrow. It reads as below:-

 

Dear Sirs ,

 

I refer to your letter dated 5th January 2006 (surely you intended it to be written as 2007) , in regard to Claim No. 6WF02389 now transferred to the Mercantile Court in Leeds as Claim No. 6LS40677 .

 

I feel your defence submitted to the courts fails to sufficiently answer the points I made in my particulars of claim submitted previously to the courts and in particular the points raised within your last letter to me.

 

My assertion that the charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law still stands .

 

I also believe that these charges are punitive in nature ; not a genuine pre-estimate of costs incurred by yourselves ; exceed any alleged actual loss , but instead duly enrich the bank which exercises the contractual term in respect of such charges with the view to profit.

 

However in light of you latest offer I would be willing to accept the amount of £2216.25 which is the charges plus interest pursuant to section 69 County Courts Act as calculated up to and including today plus costs of £120 for submitting my claim form and £100 for submitting my allocation questionnaire (which you seem to have omitted from your offer).

 

This amounts to £2436.25 .

 

I am willing to hold this figure for the next seven days providing I have received confirmation this is acceptable to you by way of a cheque or transfer to my account before the close of business 15th of January 2007. Upon receipt of funds I shall lodge Notice with the Court by way of a completed Notice of discontinuance with immediate effect .

 

In all circumstances I believe this to be a fair offer and is made in an attempt to resolve this case without the need to incur further court time and costs. I would consider this to be a full and final settlement to this particular case and would supply you with a letter confirming this .

Congratulations you jammy dodger you.:D I don't think it would be greedy to insist on interest to the date of settlement, just your entitlement, but at long last this will be over, so congratulations again my old mucker.

 

Maybe you will start going to bed at a reasonable time now rather than haunting the forum in the wee small hours. Then again if you do that who will I talk to?;):rolleyes:

Hi Jules I have read your posts with intrest.I am a Yorkshire bank customer.The only charges I have incurred is for exceeding my agreed overdraft limit,they charge me £8 per day for this breach.i didn't think this excessive until I read your thread.The thing is over the last 6 years this would add up to large sum.Is this the sort of charge you can challenge or are we talking about fees for unpaid direct debits etc which are usually charged at a much higer rate.Any info would be appreciated.

Sorry for the delayed update , I was waiting until the cheques had cleared my account.

 

Soooooooooo, yes finally YB have paid both my claims in full(well almost)

 

The joint account was £9 short of full settlement + costs + statutory 8% interest to date of settlement and my own account £13 short . It just goes to show that if you are able to hold out the whole way you will win in the end. It has been a rollercoaster ride starting with the SAR `s in June .In fact it may be helpful to people if I list the whole timescale thing

05/06/06 - S.A.R`s sent (both acc`s)

28/06/06 - Copy statements received (both acc`s)

03/07/06 - Prelim letters sent (both acc`s)

18/07/06 - Sod off letters received (both acc`s)

29/07/06 - L.B.A.`s sent (both acc`s)

07/08/06 - Stalling letter received " we will look into it "

07/08/06 - "Tier one"(sod off again)letter received (Branch Manager)

15/08/06 - £200 "without prejudice and threat of counter claim" offer received (joint acc.)

19/08/06 - Thanks but no thanks ,see you in court letter sent (joint acc.+ reminder they still have own acc.to deal with)

24/08/06 - "scare tactics/threat of counter claim and costs" letter sent to me 24/08/06(Neil McKirdy)

29/08/06 - Submitted N1 for £416.06 +8% +costs +disclosure (joint acc.)

26/10/06 - Case transferred to Leeds County court (own acc.)

06/11/06 - A.Q handed in no fee payable (joint acc.)

12/12/06 - Both cases transferred to Leeds Mercantile Court

18/12/06 - Full offers received without the statutory 8% interest , refusal letter sent

06/01/07 - Full offers +costs +8% to date of claim ,refusal letters sent

22/01/07 - Full offer +costs +8% to date of settlement less £13-ACCEPTED

27/01/07 - Full offer +costs +8% to date of settlement less £9 -ACCEPTED

Letters of acceptance to post tomorrow as well as discontinuation to post to court now that cheques have cleared .

 

And thats it..................so far.....................

 

Charges incurred on joint account since the date of claim (29/08/06) to be added up from the statements and then its round two. Will start a new thread for that one and link it from here when I do .
