      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Monday I had offers for both accounts

 

Full amounts claimed + court costs but.......................

 

No 8% interest so I`m sorry Miss Ross my letter of refusal is on its merry little way to you.

Hi Jules

 

On a nod from Caro I thought I'd find your thread and say hello.

 

We have something in common in that we are both at the Mecantile court on the 7th Feb 07 with the YB.LOL

 

I have never started a thread on my YB claim as they appeared to be the hardest Bank to crack and I was under the impression that they wrere monitoring the site.

 

However I am not in the least bothered now as I have a court date and all corners have been covered.

 

Are you on the list ?I am number 39.

I can`t actually find a date on my paperwork so I`m assuming it hasn`t been set for my cases .But if my cases are on your list for the 7th please let me know as it will help me out

Have just picked up your PM and pm'd you back.

 

My letter does state a group hearing on the 7th Feb and you are definatly on that list.

I think I've been added on after you got your letter.

 

I know A Wadsworth and when she got her letter I wasn't mentioned(she's number 26).

 

I would presume that there may be a few more on the same hearing.

 

I really would love to go and battle, and it would be great if we meet up on the day ,but I have a feeling neither of us will probably actually have to attend.We shall see.

Looking forward to Feb 7th will great excitement just hoping YB don`t actually settle before then, but sadly(or not) we know they will.

 

Shame really as I have all my documentation , arguments , case law and everything ready and waiting . Hey ho will just have to try again with round two of charges since this little lot.Also have a few neat little tricks:cool: for round two so if they have any sense they will pay up a lot sooner as it will end up costing them more than this claim :D.I wonder if they`de be prepared to offer me from the prelim letter this time (would rather they didnt so I can pull the ace from my sleeve),but you never know.

 

Keeping an eye on all the Feb 7th cases to see how quickly YB crumble.

Jules, just to let you know that my case against Natwest has been transferred to the Mercantile Court in Leeds in Feb. Might see you there (if ever we get there).

 

Also was just reading your thread as my sister has just received a cheque from Yorkshire Bank which is less than half the amount she is claiming. The letter states that encashment of the cheque will be seen as her full and final settlement acceptance. Im so glad its Saturday, because she would have been skipping off to the bank to cash it had it been open!

 

Its a huge carrot they are dangling! Wonder how many others are so desperate for the funds that they cash the cheque?

Hi All

Letters came through yesterday offering the full amount + costs + 8% to date of claim. Basically I lose about £50 interest on my account and £10 on the joint account but I feel it would look greedy to the judge so I think I have to accept their offers.

 

Letter of acceptance going in post Monday with a little add-on reminding them of the charges I will be persuing since my claim went in , I may even make these a condition of my acceptance.

 

Its been a long haul and a bumpy ride and without the help and support of everyone on here ESPECIALLY CARO I would have probably backed down ages ago. Lots more people to thank in my next post when I have finally got the money in my account.

 

I will also complete the survey and of course be making my donation to this fabulous site.
