    • Please provide advice on the following situation: I rented out my property to four students for 16 months until March 2024. Initially, the property was in very good condition, but now it needs extensive renovation. This includes redoing the bathroom, replacing the kitchen, removing wallpaper, and redecorating due to significant mold growth. The tenants also left their furniture on the grass, which is owned by the local authority. As a landlord, I've met all legal requirements. It seems the damage was caused by poor ventilation—windows were always closed, and heating wasn't used. There was also a bathroom leak fixed by reapplying silicone. I tried to claim insurance, but it was denied, citing tenant behavior as the cause by looking at the photos, which isn't covered. The deposit barely covers the repair costs, or else I'll have to pursue money claims, which I've never done before and am unsure about its legal complications or costs. Any thoughts on this?
    • The part in question was bought direct from Hotpoint (to replace a burnt door interlock and melted wiring). I'm unsure of the original retailer the machine was bought from, we're talking 5 years+ ago, but I can find out if absolutely necessary. It's one of the models that was listed on the recall list, but Hotpoint have stated for many years it wasn't an affected unit when given the serial number - I expect this is why they offered a FoC engineer visit because I sent them pictures of the (new ) burned door interlock.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Spoke to a pal of mine who works for Halifax (HBOS) who said they are getting 6 DPA letters a day at their branch. They are refunding charges to people who go over their limit on rare occassions, others who do it monthly will be refused!

Seems a rule for some but not others.

Received acknowledgement letter this morning from Linda Young and my cheque has been returned, as they are supplying statements free of charge.

Last 6 years statements arrived yesterday morning (Tuesday) by courier, notes make interesting reading, they are threatening me with withdrawal of services!

Finally had time to work through my statements and totaled up excess overdraft fees, returned DD's and interest on charges on account and it came to a mind boggling £4258.73.

 

I remember when I had an agreed £1000 O/D one day and they reduced it to zero the next day! Loads of charges. I remember when I retired after being off sick from work for a full year (half pay + loads more charges) my lump sum pay off came through and they offered my wife a Visa card with a 28K limit!

 

Their notes are quite economical with their info., after telling them for the last year I was having probs with the Tax Man (Inland Revenue mistake) there is no mention on any page of these probs.

 

Rant over, letter on its way, pay back time, after having got money back from Standard Life for endowmwnt mis- selling, FD your next on my list!

Reply back today and surprise, FD does not agree with my arguement!

I take it that I now send LBA letter to them?

 

Going on holiday next Friday for 2 weeks so I will have to watch the timing.

Just back from holiday and surprise, Mr Kernaghan does not agree with my LBA letter, now going to proceed through legal methods.

Have posted on Scottish site to ascertain where to lodge claim.

FD now closing down my account, I'm getting letters from companies stating I have cancelled my Direct Debit, pity FD did not write and tell me.

Under DD agreement are they allowed to do that?

Hi

I have just joined this website.

 

I am really keen to try and get my charges back but I am really concerned it will effect my credit rating.

 

What are your views on this.

June 26th 2006 Data Protection Act letter sent to FD

June 29th 2006 reply from FD.Statements are on there way.Returned chq

July 7th 2006 requested refund of £3500 from FD

Hi Bev and welcome. Firstly you should start your own thread with any specific questions such as credit ratings. Read the FAQs and step by step section - loads of useful info. Also read others threads and search for the terms you're looking for.

Generally it shouldn't affect credit ratings but every case is unique - but not that unique ;-)
