    • Thank-you dx for your feedback. That is the reason I posted my opinion, because I am trying to learn more and this is one of the ways to learn, by posting my opinions and if I am incorrect then being advised of the reasons I am incorrect. I am not sure if you have educated me on the points in my post that would be incorrect. However, you are correct on one point, I shall refrain from posting on any other thread other than my own going forward and if you think my post here is unhelpful, misleading or in any other way inappropriate, then please do feel obliged to delete it but educate me on the reason why. To help my learning process, it would be helpful to know what I got wrong other than it goes against established advice considering the outcome of a recent court case that seemed to suggest it was dismissed due to an appeal not being made at the first stage. Thank-you.   EDIT:  Just to be clear, I am not intending to go against established advice by suggesting that appeals should ALWAYS be made, just my thoughts on the particular case of paying for parking and entering an incorrect VRN. Also, I continue to be grateful for any advice you give on my own particular case.

BUT... in some instances, like this one...you dont quite match the advice that the forum and it's members have gathered over a very long consensual period given in a tried and trusted consistent mannered thoughtful approach. one could even call it forum hi-jacking and that is becoming somewhat worrying . dx
    • Yeah, sorry, that's what I meant .... I said DCBL because I was reading a few threads about them discontinuing claims and getting spanked in court! Meant  YOU  Highview !!!  🖕 The more I read this forum and the more I engage with it's incredible users, the more I learn and the more my knowledge expands. If my case gets to court, the Judge will dismiss it after I utter my first sentence, and you DCBL and Highview don't even know why .... OMG! .... So excited to get to court!
    • Yep, I read that and thought about trying to find out what the consideration and grace period is at Riverside but not sure I can. I know they say "You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is"  but I doubt they would disclose it to the public, maybe I should have asked in my CPR 31.14 letter? Yes, I think I can get rid of 5 minutes. I am also going to include a point about BPA CoP: 13.2 The reference to a consideration period in 13.1 shall not apply where a parking event takes place. I think that is Deception .... They giveth with one hand and taketh away with the other! One other point to note, the more I read, the more I study, the more proficient I feel I am becoming in this area. Make no mistake DBCL if you are reading this, when I win in court, if I have the grounds to make any claims against you, such as breach of GDPR, I shall be doing so.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

We're having problems at the moment trying to get Holiday Insurance for my Dad, as he has prostate cancer (affecting his bones too).

 

I was speaking to a Nurse this morning who asked me if he had a Platinum Card from a bank, as he should be able to either use it for insurance, or get insurance on it (I'm not too sure about that part to be honest).

 

Anybody understand what the Nurse was referring too, or know a way around this ?

Most platinum bank accounts come with free extras and travel insurance is usually one of them.

 

I think this is what she means.

My mum has lots of pre-existing medical conditions & in her late 70's last time I got her an insurance policy from intune travel which wasn't too bad a price & could be done online too without having to go through to a helpline going through lots of medical questions like lots of other travel ins co. (which can be tiring!!!) :rolleyes:

 

Have you tried googling cancer travel insurance, to see if perhaps you can get something fairly reasonable that way, hope you get something sorted for him soon or even better find he may be covered already on one of his bank acct card/policies. :-)

I would advise being cautious with bank account insurance [sorry PF]. A few years ago I was offered this with my current account, but on reading the small print, it said they wouldn't cover pre-existing conditions. I reported my fairly mild back problem and my OH said he had a shoulder problem, and they immediately excluded both.

 

Please be careful.

Honey no need to apologise as I am fully aware of the cons, and I should of said that but I was just putting an answer to the question.

 

I had the same with the insurance that came with my bank account, oh and it aint free as they said it was as the platinum account I had cost £12 a mth.

Hi PF. I think I know the bank you mean, and am still wondering if it's better to have our own insurance we can depend on or use the bank's and not really understand what they might pay for... I could have a no-charge account and pay for the benefits I need rather than all the add-ons, some of which I don't want.

I insure my wife who has many pre existing conditions (although thankfully not cancer) with a firm called Travelbility who are actually AXA and the premium for a two week trip to Turkey ,which turned into three because of the volcano seemed quite reasonable at £105 for three of us.

 

They gave us a free week because of the ash which covered us until we got home.

 

I did though, have to claim as I had a chest infection and ended up in hospital and they paid the hospital direct leaving me to pay the £50 excess.

We did though have a problem as my wife got the same thing and as chest complaints were a pre existing condition, I had to pay 850 Euros as they wanted me to produce evidence i.e chest x ray medical report, which I have produced I am in the process of claiming back,

I`ll keep you posted but do make sure you tell them everything as I`m pretty sure they share a database so once you`ve declared a pre existing condition it is there for all insurers to see.

I don`t think that I would risk relying on a bank card. Also if going to the EEC make sure you take his E111 plastic card. Also sorry if I`m teaching you to suck eggs if you can get a `fit ti fly` letter from your GP.

Thanks everyone for the advice. Looks like I'll steer clear from the bank card thing, and start contacting the ones you have recommended. :)

 

I didn't think it was gonna be this much of a pain in the ar$e, but it turns out it's because we're going to Greece, and with their financial difficulties it costs big money if somebody was needing treatment over there.

Hello again. I saw something on TV the other day about a lady who had started her own company to insure cancer sufferers. Sadly, I didn't take note of her name, but it's a specialist company.

Just to confirm what others have said: Do NOT under any circumstances rely on a bank card insurance, they are exactly like other inscos and do not cover PMH!!! The nurse, whilst well-meaning, has no idea what she's talking about!!!

 

Insurances through a bank card are exactly the same as others, they will hav the same underwriters, and will go through the same emergency services, the only difference is the phone number so that when you call, the person knows to say "X emergency services, how can I help you" instead of the generic one.

 

The EHIC is a must (not called E111 anymore!) for travel within the EEC as previously stated and I must say that if you are travelling within the EEC and something goes wrong, you are often better off in the state hospital than in a private clinic, especially for "heavy" conditions. :-|

 

Eyeball, your insurance didn't extend it out of the goodness of their heart, if you are delayed abroad through no fault of your own, every insco will have to extend cover until you are back in the UK, unless you refuse to travel even though there is no valid reason, in which case, they'll warn you they'll cease cover from X date.

 

Honeybee, unless there is a specific reason you want to pay your bank extra, the added "benefits" seldom add up in terms of costs and use, they are a huge money spinner for the bank, and usually very poor value for money. For tvl insurance, you'd probably be better off with picking your own as and when you need it (only really regular travellers should bother with annual policies tbh) and this way you can make sure that the terms are relevant to you. ;-)

I tried to get annual insurance but the companies I tried would only insure specific dated because of the pre existing conditions
