I have been in some email contact with my so called account manager and says my account is going to DCA on may 1st which i think i will actuially be pleased about. They never listen to any offer of money and always asking for more even though they clearly know you cannot afford it.

 

 

I received this email today and wondering how to responsed

 

Thank you for responding to my email.

In response, please be advised that with regards to the frequency of the calls

made to yourself I can assure you I am acting within the OFT guidelines, as you

may check yourself. I apologize if the frequency displeases you however they are

not made, as you have claimed, daily, as we have each call recorded on our

system. I have in fact called you only 5 times in the past 4 weeks, those

being:

 

1st call 29/03/2010 1:57PM

2nd 31/03/2010 5:39PM

3rd 07/04/2010 12:43PM

4th 09/04/2010 2:24PM

5th 13/04/2010 12:01PM

 

Therefore, your claim to harrassment is unfounded.

 

As regards your token payment offer, unfortunately you signed a contract with

the company whereby you agreed to repay your balance in full on 25/03/10 and

you have since broken this promise.

As stated in the Terms and Conditions, we do not offer any roll-overs or

extension since this is, as the name suggests, a payday loan. I have already

held onto the file a further 4 weeks from the date the file was passed to us. I

will continue to hold it till the last day available to me, which in this case

will me May 1st, giving you enough time to use another paycheque instead should

you need it, and then the file will be passed over to a 3rd party debt

collection agency who have the ability to go door-to-door as previously

advised. However, should you somehow manage to settle the balance by this date

you will be free to use the services again as normal and even reloan the same

day payment is received should you wish.

 

Generally we could have settled this in one phone call had you answered any

of them when I was attempting to give you enough time to come to a decision.

Unfortunately now we have very little time to work with, so I recommend making

payment as soon as possible to avoid the aforementioned escalations.

should you require further assistance.

This is my draft reply as i do not agree which her call times and a few other points:-

 

 

 

 

As previously stated I will only conducting communication with you via written means so that it is fully recorded in any given audit trial.

 

It is interesting that you state you called me on 29/03/2010 1:57PM. I have plenty of missed calls on that day from withheld numbers which I presume you must be one of if you state you called me on 29/3/10 but no such call at 1.57 exactly. Please can you enlighten me to which phone number you claim you phoned me on at this time?

 

You yourself stated that in your original email that you had been calling both my mobile, my home and my work number which is classed as harassment if you phone one number then the other repeatedly in short succession which I know someone from your company did even if it wasn't you as one several occasions my mobile would ring and then my home phone number and both had messages left asking to call your company and that as in the oft guidelines on debt collection is classed as harassment.

 

My token offer is all I can afford and you are pressurising me to make payment that I clearly cannot afford which is another breach of the OFT guidelines with regards to debt collection under the Physical/psychological harassment section 2.6 (f) pressurising debtors to pay in full, in unreasonably large instalments, or to increase payments when they are unable to do so.

 

Also your claim that i broke my promise to your company is unfounded. When I signed my agreement with you I did so with the full intention of paying it back and still have that intention just at a reduced rate due to my financial position. At the time of the loan I was not aware of the event that brought me to this financial limitation for the next few months otherwise I would never have borrowed the money in the first place.

Just forget the hazzle with the idiots at PTP, they are not worth the trouble...

Just let them pass it on to Clarity, i had same trouble....

But after it went to Clarity and they sent me a letter, and also email, i explained (replied back) in an email my hard situation etc., and they agreed that i can pay now 20 pounds each month...

I also put out that i will not pay the 2 x 59 pounds they had added to the debt, so i said in email (this is just example as i dont want to put exact amount to maybe be recognized...)

 

they set the account was : 657,72

 

So i sent in that email to clarity that i will only accept with out the 2 x 59 pounds which then would give : 59+59-657,72 = 539,72

 

Funny thing is Clarity has not answered about that, only that they accept me to pay 20 pounds each month for next 3 months and then they will put it under new review...

But i will stick to my guns, and when i come to the end where i have paid down to where only 2x59 (118 pounds) is left, then i will not pay anymore.

And the fee charge of 59 pounds PTP add is unlawfull according to rules.

I have been in same situation with PTP basically ignore all communication form them until it is passed to Clarity which takes approx 4-6 weeks - PTP "account managers" don't negotiate at all so basically they are just ringing and emailing to chase full payment. I defaulted with them at end of Feb and heard from Clarity last week (obviously there was Easter in between too) Clarity are much bette to deal with.

hi there

i myself found i could not make the repayment of my loan due to finiancal problems. after this i received numberous phone calls to my work place-not my home number which they had and they even left messages on the phone "hinting" i was in debt. as i work in a health care setting my manager took me aside and advised me of the calls and messages and said they had to stop....embassement or what.

i e-mailed the person named on the calls and received not reply just an e-mail saying it was going to be referred to a debt collection agency unless i contacted him asap. which i tried to do....put on hold...when i did speak to him and asked him not to ring my work number he became very angry and would not listen to me.

i spoke to CAB and they said to let him refer me to the debt agency as they would be more symthapathic to my problems and would arrange a reasonable repayment program for me.

this morning i woke up to find they had again requested the total amout in full and it had been paid!!!! i did not sign a new direct debit for this date so how have they done this and now i can`t contact them....is this lawfull....i will now have to go back to CAB to sort this out...in the meanwhile i can not pay my other bills because thsy have taken all my money...........:shock:

OMG keep this sentence to hand should this escalate! This one single sentence illustrates perfectly that they are completely irresponsible as a lender.

 

The sentence implies recognition that you are having difficulties meeting your current obligation to them, and encourage you to find the money which they will happily LEND YOU BACK straight away, knowing full well that you will be in the same situation next month!

 

I'm not even sure that is legal.

 

I have my own loan with PDUK (see my thread) and I remember their literature stating (at the time of a reloan) that as they were responsible lenders, they could not issue a new loan until 3 working days had passed since settling the old loan. I know that's just rhetoric on their part, but at least it's a token effort.

Dont worry I have a similar email from wonga and i made a complaint to trading standards so going to see what Trading standards do and if they take it seriously will complain about PTP too.

 

I dont think PTP situation will escalate much more as of 1st may my file goes to some third party who i will be willing to negotiate with better than them. They seem to employ morons. Although saying thatg i am sure DCA employs morons too ;)

I must say i was bit nervous of them taking my money via dd last night as my salary hit my old account today. Stayed up till 1am to move it into my savings. My debit card has been replaced so they dont know that number but you never know what they will do with a in the middle of the night direct debit. I will be moving my employers salary into my self employed business account for timebeing each month i think as dont really want to go through all the hassle of totally new personal account.

I have just spoken to Clarity and set up a payment arrangement with them I have also had a £275 late fee applied to my account from PTP which I will be disputing. I have found Clarity to be much better to deal with, they seem much more reasonable and they also said when I mentioned about phone calls from PTP and attitude of PTP staff she said that they get lots of complaints about them and their staff....hmmmm really doesn't say much for PTP when Clarity acting for them.

Good Afternoon all, i am after some help please, I defaulted on my PTP loan on the 24th April, since then I have had a few phone calls from Marc Johnson, he has left very nasty bulling messages on my answer phone, Now I can repay the money and I refuse to keep going through this every month I agreed at first to repay the lot on my next payday but since then I have sat down and thought about it and I will never get out of this mess I have been in for the past year enough is enough, Now I spoke to him yesterday and I said I have all the messages he has left on my answer phone and they are bully boy tactics, he has threaten to call my work which is a disgrace as I have always returned his call, he proceeded to tell me that if I didn’t repay the whole amount by the 31st may it would be sent to a Third party which he told me that Northway use so many debt recovering agencies and I could end up with them knocking on my door, (another threat). He then asked me to agree verbally on the phone that I would pay the whole amount at the end of the month I refused and said I would only deal by email now, I have just checked my email and I have a letter stating I need to acknowledge that I got the email agreement and stick to it. Sorry for the long post just trying to get some help don’t know where to go from here.

Same old PTP

 

Ignore them and wait for them to pass to Clarity. You can then negotiate something that you can afford. PTP's own people are always unpleasant by phone but they have to pass to DCA (usually Clarity) after 4/6 weeks.

 

There are regulations that PTP should comply with and their threats are out of order. The trouble is by the time you deal with that through the correct channels they have passed on anyway.

As stated before I am now dealing with Clarity on behalf on PTP but just wondered if anyone else (who's account is now with Clarity) has had a £275 default fee added on. They have done this to me but I fully intend disputing......they make me so mad....:mad:

Just refuse to pay it. They won't take you to court for it. I would pay them nothing until they remove the charge. Alternatively you could make your monthly payments (that you are happy with) then stop when you have paid back the amount you actually owe and perhaps one months interest if you are feeling generous.
