    • Thanks all for all your input. I have decided to follow this all the way. So far, I have not replied to Alliance Parking's original NTK letter. The time-period for the reduced amount has now finished, and the time to appeal (21 days from the date of letter) will finish on 25th Apr. No further comms received from Alliance Parking. Could you please guide me, for my readiness, on what happens next? Am I going to start receiving letters from Alliance Parking > Debt Collector letters > Letter of Claim? Who sends me the Letter of Claim - Alliance Parking / Debt Collectors / Solicitors / court? How many weeks / months from now is this likely to be? Once Alliance Parking passes the debt off to the Debt Collectors, is there a risk of anyone turning up at the door? Do I need to reply to any other letters from either the parking company, debt collectors, or solicitors? Many thanks in advance.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Halifax took this cagger back to court to have the original decision overturned. cagger now has to repay the monies awarded in respect of charges to Halifax :confused:

 

It asks " click here to help CAG", but then refuses access (by order of the site team)

 

What the hell's the problem ?

Something was definitely wrong with that original link as I had the same messages as above when I originally tried it.

 

I have now downloaded the toolbar and will endeavour to use it regularly. When exactly does CAG get paid? Is it whenever the toolbar is used or when a link is clicked from the result of a search?

The matrix is intrinsically flawed. Within it is the program for it's own destruction. If you are reading this, you are in the matrix and it's days are numbered...so watch out! :eek:

yep still doesnt work even if i copy the link location and paste it in my browesr i still get the access denied page.

 

Maybe it only works for you mod's meaning that for some reason the site is denying access to alot of us members.

 

Of your just working on banning the lot of us from one thread at time lol :p

I can tell you what it is:

 

when admin put up the link, they were working from wherever they were at the time, which would be restricted access, and for some reason, that means the link is only accessible to people who have elevated permissions, ie admin, site team, webmaster (which is why CitB doesn't see what the problem is, lol). Hence us plebs only get the "you have no access" message. It's a bit like if a non-registered person tries to access the templates, they will get that message too. Or if an ex-team tried to access threads from restricted forums having kept the URL. I've never worked out of it's a glitch or an addtional security measure to avoid prying eyes, but it happens. It needs to be changed at upper permission level.

 

Once that's sorted out, maybe all our OT posts on the topic could be moved to a different thread so as not derail this thread further? ;-) :razz:

Lol the original link was to a page for us to download the plugin, thats all.
