Could someone please take a look at the following form and see if it is enforceable

This document is an application form. The enforceability depends on when you entered into the agreement and whether you received a set of terms and conditions with this application form.

Yes but what T&Cs did you get at the time the application was signed. The wording states that you have received T&Cs when you applied, so did you?

61.-(1) A regulated agreement is not properly executed Signing of

unless- agreement.

(a) a document in the prescribed form itself containing all

the prescribed terms and conforming to regulations

under section 60(1) is signed in the prescribed manner

both by the debtor or hirer and by or on behalf of

the creditor or owner, and

(b) the document embodies all the terms of the agreement,

other than implied terms, and conditions

© the document is, when presented or sent to the debtor

or hirer for signature, in such a state that all its terms

are readily legible

Section 61.1 cca 1974

Section (b)states document should have all Ts&Cs embodied in document

No Ts&Cs at all just the app form as shown
