All,

 

been a long time but, yet again i find myself in need of your help.

 

I spotted a £10 withdrawl from my account last month which i didnt recognise, entitled Brittanic Assurance (now Phoenix). I phoned the bank (clydesdale) and they said it was a standing order i set up in 2001, they also supplied the sort/account number it was paid into.

 

I then phoned Phoenix and they said that the only thing i ever had with them was cancelled by me in 2005. I asked them to look into this.

 

Got a letter through to day from Phoenix which basically says,"if you think we have been taking money from your account since 2005, prove it."

 

Spoke to the bank and they have confirmed that the tenner has been going to Phoenix for the last 6 months, any further back and i will need to FOI my account.

 

Has anything similar happened to anyone else? And do i have to prove to Phoenix that they have taken my money or are they just chancing their arm?

 

any advice gratefully recieved,

well cancel the SO thats for sure!

All,

 

i got my bank statements in yesterday, and Phoenix have been getting a tenner off me every month since the "cancellation" of my policy in May 2005, some £590 in total.

 

I am drafting a letter to them to ask for my money back. Can i threaten them with going to the FSA if the fail to return the money, in say 2 weeks? Further can i ask for statutory interest on the £590 or is that pushing my luck?

 

Any help gratefully recieved,

there are a couple of things here.

 

the nasty one is i doubt you will see this money again.

a SO would have been set up by you.

if it was not cancelled then its down to you too...sadly.

 

now, ok.

lets see what pnix will do now

 

reply to the letter stating your have SAR'ed your bank and have official docs to prove they indeed HAVE been getting £10PCM between XXX date and XXX date.

 

I want this money back.

 

i bet they tell you to bugger off!

Guys, a wee update:

 

sent a letter to phoeinx asking for my money back at the start of June, with redacted copies of my bank statements. No response yet.

 

I was at a trade fair the other week and was speaking to the rep from the FOS about this. He said that Phoenix have 8 weeks to give me an answer. If i do not get my cash + statutory interest, within 8 weeks of my letter, then i should get in touch with them and they will take it on.

 

So, as i dint ask for statutory in my letter 4 weeks ago, i think i will write to Phoenix again and ask for an update and drop in the fact that i am also looking for the interest!

 

Which brings me on to...how do i calculate the interst on this? It was almost 5 years of payments at a tenner a month. Is it calculated as £120 per year or does it need to be calculated monthly is it gradually accruing?

make yourself a table/or spreadsheet.

 

use this:

Compound interest calculator

 

in the prin box put the amount

rate of int = 8%

number of rests = 12 comp mntly

start date = date of charge [each will be diff!]

end date = date of you claim [today?]
