      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

....because I overdrew 51p!!! The first I realised my account was closed was when I received a letter from my car insurance advising me that my bank had cancelled the DD. How come they knew before me? The letter I received states they are giving me 30 days notice but will cancel my card as of the 12th April. The letter was dated the 29th March, I received the letter on the 1st April, and with the bank holidays etc this only leaves me with 5 days to open another account, which isnt going to be easy as I went bankrupt last year! From what I have read on the Banking Code, if I have read it correctly, they have to give 30 days notice, yet why have the cancelled my direct debits already before informing me? Are they within their rights to do that?

 

Anyone have any advice please?? Im getting pretty desperate here wondering who will give me a bank account now????:-(

What account is it ?

When did you open it ?

Is there any overdraft ?

How have you managed it over the last few months ?

Has there been any previous warnings ?

Have you been in any dispute with them ?

They did the same to me and my partner mate, they paid a DD that had been cancelled ! yes both ends, so should not have been called for... put account O/D... they sent letter, cancelled cards, cancelled Direct Debits and closed account 14 days later sending me a cheque for account balance as money had gone in.... even though I could not withdraw it out via card, they cancelled them !

Hi Martin,

 

Its a Cashminder account, no overdraft facility, have been with them 13 months and overdrew just 4 times, no more than £5.00 max each time and monies was paid in same day to clear the debit. Terms and conditions state 3 strikes and your out, but even so, I thought they had to look at each individual account sympathetically. Its just plain black and white with them, you overdrew, you're out! I asked if I could appeal the decision and they said no, that was final.

 

I just find it frustrating that the banks have so much power and those that have suffered financial hardship through no fault of their own get penalised. We are all human and all go through times of difficulty, its not like I abused the account and overdrew hundreds every month!

Apart from openeing up another account, I dont know. Coop are quite strict on the cashminder account going od. I was told if go od once, bye bye. I didnt realise there was three strikes policy.

 

Have you tried the post office, they have a basic account xx

there is nothing in the booklets you get given about this bankaccount that if you go overdrawn the account will be closed false advertising,like the fake guarantee if you get robbed or do not recognise transactions......staff dont even know anything about visa charge back they are suppose to have suspended closer of my account while fraud was investigated but still carried canceling my dds costing me £1000 not to mention the amount i have had stolen see you in court co-op bank i will get my money back you are no better than the thiefves who stole my money in fact your worse ur brain dead idiots without any repsect for your customers,dont think u will get away with doing wot u plz not this time read the regs and train your staff to have some respect and to stop lying to people
