      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I am trying to sort out a co-op student account which i have been defaulted for.

 

Basically i had a student account and it was closed within the first year of use due to not enough payments being made into the account. I was first contacted by a debt collection agency called phoenix who i arranged monthly payments for in june 2007. I was currently still a student and going into my second year at university in sept 2007. I couldnt afford the payments and stopped making the monthly payments in october 2007, and i didnt hear anything about the debt until feb 2008 from a differnet debt agency called fredricksons who i now have a monthly payment arrangement of £10 per month.

 

I checked my credit file and there has been a default put on my file in december 2007. I am quite positive i wasnt sent any letters stating i would default my account or a default would be put on my credit file, if i did receive this letter i would have done something about it, i have read around and im sure they have to give you time to respond before putting a default on. Would there be a chance i could get this removed?

 

Any help will be greatly appreciated on this matter, i wouldnt be so bothered about my credit file but most jobs relating to my degree require credit checks and i have been rejected for all the jobs i have applied for due to my credit score. I only have the one default from co-op, its really depressing me and it just seems all my hard work i put in for 3 years has gone to waste.

Hi,

I take it this was an overdraft?

 

The only advice I can give is to SAR the CO-OP and get an account history to see if they did default you and also to check to see if letters were sent.

 

If it shows that no letters were sent then you may be able to get the default removed but to be honest, it's like pulling teeth. The banks just love having this 6 year hold on you

Thank you for replying back.

 

I checked my credit file recently and an default has been definately applied to my credit file by CO-OP i cant remember if it was CO-OP or the debt collection agency who put the default on, i will check it agian.

 

What if the bank or the debt agency did not send out a letter, what can i do?

 

I am prepared to what ever it takes to get this removed so i dont mind how long it takes, im pretty much screwed jobwise so an extra few months unemployed wont make a difference to me.

It would have been the co-op that put the default on your file but when a debt is sold (rather than the DCA collecting on behalf of the co-op) the new owner of the debt will replace the co-ops name with their own.

 

If it can be proved that the co-op didn't default you, you can then start the formal complaints process

How could i go about proving co-op didnt default me?

 

I can remember getting a phone call from phoenix debt collectors and i setup a monthly payment arrangement. On the same day i setup the payment arrangement i went into co-op bank and asked why my account was closed they basically said not enough payments were made into the account and it was phoenix who were dealing with my account.

 

5 months later the default was placed on my file so im pretty sure it was phoenix, but im not sure if phoenix debt collectors are with co-op or if they are allowed to put a default on my file. if they are not allowed then i think i do have a case.

I have checked my credit file agian and it shows the default under co-op but the new company fredricksons are not displayed anywhere also phoenix is not displayed anywhere,

 

If i subject access request them and co-op did put the default on, would i be able to request a copy of the default notice?

 

i have heard you cant request a copy anymore?

Default notices are system generated and they very rarely keep a copy so all they do is to make a note on the customers file that a DN was issued. This would show up on screenshots of your account when they send you the data from your SAR (assuming they send it all)
