I received this letter today on behalf of my mate - the actual loan itself is from 1995 and they have no signed credit agreement.

 

However, I requested the Default Notice as a matter of course (in light of their threat of court action) and they returned this:

You say the loan is from 1995 and they dont have the CCA do you mean

Lloyds or your mate

 

It seems a very long loan also the default notice was sent in Oct 09 they

will get someone to swear that it was sent 1st class , if they dont retain

D/N then surley they wouldnt retain undelivered mail!

 

Seems that they dont want to go to court as they have stated they are

willing to accept monthly payments to suit your mate .

 

More like they dont have the CCA and cant proceed to court without it .

 

I have first hand knowlegde of **** and they will duck & dive to suit.

Sorry I should have explained better. The original loan was 1995 and then chopped and changed over the years. The last agreement was completed in 2005 but no documents were signed etc. They even admitted in a letter that they do not have the signed credit agreement.

 

I was thinking the same thing about undelivered mail too... that said, I have received EVERYTHING from my mate (he is a stickler for the details) and no DN was ever sent to him.

If you read the letter carefully it doesn't actually say that the DN was actually posted.

 

If, by chance, it was posted then it wasn't sent by recorded delivery. Nor was a certificate of posting obtained.

Otherwise they would leap into action with one of these in order to prove their case.

 

If it wasn't posted then naturally the Royal Mail wouldn't have returned it undelivered.

 

They are hoping you will overlook these points.

I really do appreciate all those 'thank you' emails - I'm glad I've been able to help. Apologies if I haven't acknowledged all of them.

It still begs the questions: where is the copy of the actual default notice? If this is all so simple, why haven't you provided it? If you know it was posted, why don't you have a copy? If it is on their systems, why is there not a copy? Are you saying they sent something, but they don't know what?

 

What a lot of blather to tell you exactly nothing!
