We are getting reports that some people are being chased and threatened for payments following them cancelling their DD mandates or else falling behind with payments.

We need people to post up details if this is your situation,so that we can offer guidance and support to address it.

If this applies to you can you post here a general outline including;

 

1.Whether you cancelled or have fallen behin with payments.

 

2.Who your agreement was with.

 

3.Who has been chasing.

 

4.What action has been threatened.

 

5.If you have made any response.

 

 

It is essential that you keep dealings in writing,where you will have proof,dont deal by phone,and if someone calls you,get their name /department and keep a log of the times/dates if they are calling you.

If you have telephone recording facilities-all the better to use them.

 

If anyone has any questions or needs urgent advice-feel free to hit the red report triangle which can be found at the lower left on any post page.

Dealing with any unjust collection demands will require all those affected to be sharing this information so we can establish a response.

This is an area where CAG has a wealth of experience in and our members I am sure will assist those affected 100%.

It is now 8weeks since Advent ceased to trade, Barclays have replied to any letters requesting cancellation by generic letters of we are sourcing a new provider any telephone conversations have all had the same reply's from them " you can't Cancel you need to accept the new provider you have no choice if you don't accept new provider you're still liable and must pay .

 

On 11/3/10 the interest free period was to end where the lump sum was to be paid On the 1st march I got the account on hold and a letter confirming this they told me to cancel DD On 16th they added £20 charge for non payment They've added interest at 29.8% more than doubled the debt. On the 22nd received a notice given under the CCA1974 notice of default sum.

With Help I have drafted a letter to send to them.

 

TS initally told me it is a link loan and BPF are jointly Liable then Next meeting they said I could be forced to pay but to wait till they find new provider and if that is not suitable then we have a case for refund but may take a judge to decide that.

2 lawyers have told me I can't get out of this I need to pay. I disagree

I have only reported here what I've been told .

We have approached Lawyers concerning a class Action Lawsuit but have had no replies.

I repeated this here as I think it may be more applicable I am now beginning to realise that because my situation is I had not began payments when Advent collapsed then that my situation is different from someone who has paid and can't be hassled by BPF.

I can provide any information that's needed and it's not only me but my Parents who have signed as Guarantor that's the real worry.

I would really be obliged to know if there's a chance to fight this in a court.

I know very little of the law

Consumer Direct said initially I had received just under 1year of the course and would likely have to pay for that much. but as Advent had ceased to trade and there is no service being provided then I wouldn't have to pay.

TS said it's a link loan when 1 party doesn't uphold the contract then the Finance provider are jointly liable because BPF are sourcing a new provider then to wait and see if the new provider is unsuitable then I will have a right to cancel

The present students of Computeach are organising a lawsuit against them because of their poor service

Legal Action against computeach | Facebook They're already financed by BPF but forums all over have complaints against them and their obviously unsuitable so why should we be forced to accept this it's ludicrous

Is there a protection in my case from s75 cca 1974

 

Probably not - I have a S75 CCA complaint with them being dealt with by a Scott Carey who sends me letters telling me he is still dealing with it every 10 days.

 

I recieved my letters about Computeach from Wilma Thomson, I would assume that these are 2 separate departments who clearly are not communicating.

If they haven't bothered to send you details of what they are providing - why do they expect you to start paying?

That's exactly it they haven't bothered too busy wanting the money. But they are not ensuring. CT has to ensure so where is BPF's obligations to honour the contract other than Ok we've done our bit so just shut up and pay up.

 

 

Apparently WE!! have to contact Computeach International Ltd so THEY CAN

arrange the continuation of your training. and they will ensure that the training supplied is of equivalent or better standard. you are obliged under your credit agreement to continue your repayments as outlined in the Terms & Conditions.

Hi, still to make a repayment to BPF, first one due in July 2010.... I understand there are going to be seperate threads set up for different circumstances, hope I'm in the right place...

Hi All

My hubby has received a letter for BPF stating how much we owe(we were due to start paying on 26.03.21) and it also says "Date of first movement 12 Mar 2009" and "Personal Message.....Arrears Due £234.82"

I'm not paying them nothing but I don't know my rights.

Help!!

Can you add a bit more ?

When did you take out the agreement-how much is it for ?

And have you identified shortfalls between what Advents was offering and what Computeach has to offer in your situ ?

Hi just found this thread, I haven't actually paid anything yet but was due to start 5th march but my account is frozen, I don't need a refund i just need the loan to be cleared so i don't have to pay.

I started the course beginning of march 2009 and not been able to pass an exam, I have had a letter from BPF saying i am now in arrears and to pay. I called them and said if the account is frozen how can I be in arrears, this is just a load of rubbish. I will not phone again I will only send letters as the call centre people are getting quite nasty

We're in the same boat, we were due to start repaying 26.03.10 but BPF put the account and interest on hold and we got a letter today saying we are in arrears too.

Are you going to ask them to keep your acc frozen until further notice?

That's what's happened to me I was due to pay the lump sum interest free beginning March but then all this happened and BPF have added the interest and sent a default notice for the returned DD for the monthly payment that was set up in case I didn't pay the lump sum.that they told me I could cancel. :eek:

So cancelled it can stay we're not receiving a service so why should we pay BPF are in the wrong I'm sure by adding interest to an account that's on hold and also they shouldn't be sending payment demands I sent them a letter I'll see if I can post it if anybody wants it I'd get it checked first see if it ok to do that.

Yes can you post the letter up. I was thinking of writing to BPF asking them to keep the acc frozen as we've not got any course info from CT therefore still not receiving the goods. (They have mention to us about DD not taken).

What course did you take with Advent, only asking cos my hubby was doing MCSE with CCNA and I've had a look and search CCNA on CT web and its not there, so if i'm right its not like for like!

I'm determined not to pay for this its all gonna happen again with BPF.

Plus they have kept us hanging on for 8 weeks so we've not been able to find alternative funds to pay BPF in full (we were advised by Advent rep to source other funding to pay BPF because of the high interest) and we can't afford £234 per month which is what BPF are asking for:-x

I'm doing MCSE with CCNA too, i will not be paying a penny and i will not be setting up new dd. I know Martin is getting some template letters set up for us, so i'm gonna use those. CT is not like for like also Advent was missold to maybe all of us. I'm hopefull since i joined this group. Everyone has been really helpfull. Aslo some of the links have been really interesting and BPF are not in a good place so fingers crossed

Yes your right someone saw before that CT didn't appear to do CCNA my course was the same MCSE+CCNA as that'll likely be the most expensive.To get more money out of us. Then someone phoned them and they're so fly they say they will provide it to Advent students but they can say anything I see that article by Sona Norris it stated no CCNA from CT.and it's not like for like in quite a few areas 12month course,paying for extra time, paying for resits etc., Pay Pay Pay!

 

All will be revealed I'll check out that letter.

Well CT haven't given us any info so they can tell us what they like and then change their minds at the last minute. Plus we've not had a new contract (not that we would sign it). All to fishy to me.

Hi all,

 

I sent a letter to BPF on the day I received the letter about Computeach. My letter was short and to the point basically stating I would be taking a 28 day period in which to assess Computeach myself before committing to anything. I also said that I would expect my account to be frozen and DD canceled as per letters from them. I also asked for them to provide me with all options available to me if I choose to reject Computeach as I had previously been approached by them prior to signing with Advent....

 

I am still awaiting a reply, but will let you know the outcome.

I am another one who received Arrears Notice from Barclays. I started my Advent course just before Christmass 09' and have first BPF payment set on early Feb which i moved max forward (28/02) in Jan (before Advent collapse announcement). My account is frozen since 5th of Feb, what BPF confirmed in written. So I demanded in 2 letters to BPF to cancel my agreement / refund anything they are about to charge me (havent payed anything in fact).

And few days ago I received Arrears Notice: Account Balance 6886,60 (its full loan with interest) and arrears requiring this notice: 228,72 (it seems like 2 payments). When I read further it states: "... total amount in arrears (inluding "Arrears requiring this notice") is 114,36". So its not very consistent, however I am not familiar with such notices (first in my life in fact).

There is something like this as well: "This is not a demand for immediate payment if we have already reached a repayment arrangement with you". I am not sure if account freezing is "repayment arrangement"? I guess not.

So I am concerned about my credit rating here.
