F and F 5% Accepted with my conditions

I thought I would post this because it seems there is a lot of conflicting advice and opinion on F & F at the moment.

 

After going through all my creditors, and finding most didnt have credit agreements, and the ones that did had dodgy ones, I have offered each of them a 5% f & f with teh conditions that

 

a) the account is closed and I will not be chased further

b) the account is marked as "satisfied" (partially satisifed is not sufficient)

c) any defaults are removed

 

None of them have outright refused, most have said they are looking into it and will get back to me. Then I had a letter from Westcot this morning, acting on behalf of Vertbaudet, accepting my offer. The debt isnt much, its £400. There was no cca and a default notice that was 2 days out BUT they have put in writing that they agree to all of my terms (and have stated the terms)

 

The acceptance letter was on Vertbaudet paper with a covering letter from Westcot.

 

For me the important thing is how little they accepted, I jut thought this would give others some hope when attempting a f & f.

 

I will let you all know if and when the default disappears.

Make sure you do not post anything which identifies you. Although we can remove certain things from the site unless it's done in a timely manner everything you post will appear in Google cache & we do not have any control over that.

Well that was my theory when I offered it, and of course it works in favour in that I get rid of the debt and clear my credit file a little for £20

Well done, hopefully you can use this 1 acceptance to persuade the others to accept your offer.

Fred if you do, I put in my offer letter that it was in no way to be taken as admission of liability and that I do not accept liability for the debt.

Yeah I put that in aswell, but I also made in clear within the body of the letter that it was not admission of the debt.

It doesn't surprise me how little they have accepted. In one of my legal cases I found out that the debt was sold for only 3% of the balance.

Hi Natalie,

 

It would be useful for us to know approx amounts and who the OC and DCA's are.

 

Gives us all hope if there is one we are dealing with and you get a positive result.

 

I am subbing to a lot of F & F threads and it doesn't seem to be an easy task

No probs, I will give approx amounts because you never know who is reading.

The ODs are mainly made up of charges, and both have faulty DNs. All of them have registered Dns on my credit file but I didnt receive notices from Vertbaudet or Lloyds CC.

 

The DNs i have received have ALL been faulty with the dates. Giving me from 10 days to -12 days (Halifax's remedy date was before the date on the letter) to remedy.

I offered Halifax 35% on a £7k debt but they said they only accept short settlements in 'extreme' circumstances, at the moment I am paying them nothing and playing letter tennis with them.

 

Cap 1, I am trying to get charges & PPI back which would more than clear the debt which was around £1700, when I stopped paying them. But have seen threads where they have accepted 15%, I will try and find it for you.

 

Hillesdens are currently involved with one of my MBNA cards but not offered them anything, still waiting for CCA requested in April 2009!

Basically I am in the very fortunate position of not caring whether they accept it or not.

 

I havent paid any of them for nearly 2 years, I dont think any of them are enforceable, so they have a choice, accept this and get something, or dont accept it.. get nothing and its SB in 4 years anyway. The defaults are all over a year old (Halifax OD was registered in 2006, so it will drop off anyway in 2 years).

 

If they accept, great, if they dont I'm not scared of them anymore, there is nothing they can do to me.

The thing that bothers me is how much they scare other people who do not have any knowledge or haven't found CAG.

Nice one Natalie. :D Make sure you keep the letters safe, as if they do pass the remainder of the amount to another DCA, you'll have something to hang them with.

 

I've been playing with various creditors for 3 years now and not paid any of them a single penny. No court action so far, but I always point out exactly why it's not wise to try taking me to court. Only one has been sold to a DCA so far and it's one that 8 DCA's and the original creditor have all admitted in writing that there is no CCA available. :D

 

My next trick is to hassle them with processing my personal data when they have nothing in writing that gives them my permission. i.e. updating default on my credit file.

 

When the other smaller ones get sold to a DCA I may try the 5% F&F and see what happens. Do my bit to save the forests if I have less DCA begging letters to file away. I have about 300 of them so far.

Thanks for this thread Natalie. Am currently waiting for my CCA requests to be fulfiiled. If my creditors can't come up with the CCA's I may do the same thing to avoid being chased for the next six years and gt the debts written off.

very much doubt Halifax will accept anything other than the whole amount. I offered Sainsbury's ( 50/50 owned with Halifax) a 50% F&F a couple of years ago and they replied stating they do not accept any F&F offers, I'm paying them a token amount each month (not agreed by them) and charges and interest have been frozen..every few months a letter appears telling me my payment arrangement is up for renewal...i file it under J for Junk and ignore them :D

Best to wait for result of CCA, when they know they haven't got an enforceable agreement thats usually when you get their kind offers of percentage off alleged debt.
