You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have only just managed to get time to put together a letter to send to them and want help wording it. I have never had to write a letter to a loan company or infact I have never had to write a complaint letter of any sort so any help is greatly appreciated.

To whom it may concern,

I am contacting you in connection with an overpayment that has taken place regarding my account.

 

On 23rd February 2010 I made an application for a £200 loan due to be paid back on 26th February 2010. The interest included made the total repayment £211.58. Upon checking my bank on 26th February 2010 I see that two payments of £211.58 where taken from my account. I then contacted a supervisor from your organization who gave his name as Tariq. He apologized and promised a £30 deduction on my next loan and a refund of £211.58 to be credited on the afternoon of 26th February.

 

I then, largely on the information provided by Tariq, arranged a loan of £126. I was assuming the deduction of £30 would be taken from this so my repayment would only be £126.14 rather than £156.14. On 17th March, £156.14 was deducted from my account. Therefore, as I largely based attaining the loan due to the promise of a £30 reduction a promise based on your organisation’s mistake, I was left out of pocket by your company’s errors. This is a breach of contract and I wish to have this £30 reduced off the future repayments (see below).

 

I received a call around 5th March from Tariq, the fraud department stating on 26th February two payments of £211.58 where refunded instead of one, he the stated that £211.58 will be taken from my account on 31st March 2010. I am not able to repay this amount, as it was spent on food and clothing for my 10 month old baby. I am however willing to agree to a repayment scheme only if it does not affect my credit history/status, as this was an error on your company’s account.

 

Total repayment- £211.58

£30 Deduction as promised- £181.58

 

27th April- £100

27th May - £30

27th June - £30

25th July - £21.58

Total repaid- £181.58

 

I refuse to pay any interest on the following as it is your company’s mistake which have caused debt to remain outstanding.

 

My whole experience with Wonga has been completely unacceptable. While as a service I find wonga helpful my entire experience has been unprofessional and error ridden. I am in a position whereby only an acceptable/reasonable reply to my acceptable offer will stop me complaining to the FOS.

 

I do not wish to be contacted by telephone or email, I demand to be written to the address at the top of the letter.

Get hold of your local CAB and get them to get the Money Laundering Unit onto Wonga, they can help here as you have a small child.

 

You will have a job finding this company's address, go for the registered address at Companies House. I haven't got it to hand at the moment but I have got it indoors.

Many thanks, i'll look into the money laundering unit there is a CAB literally 2minutes from me, what help would I expect from them? Should I just arrange an appointment and go down and explain the situation?

 

They have an address at the bottom of their webpage but I reckon if I write to that I won't get a reply.

I just called my bank and said I "lost" my card. Is there any other way they can take money from my bank, i.e. sort code and acc number?

 

They DO have my sort code and account number, also checking my wonga account it say's that the £211.58 will be deducted on 31st March. Can I ring my bank and explain the situation and put a hold on any money being taken from my account from wonga?

I sent the letter with the only reply stating they recieved it and tried to contact me with no luck (i got no phone calls), just recieved this email this morning:

What should I do, surely they cannot add interest to this! I cannot afford to give them any money at the moment i'm struggling to keep food on the table and petrol in the car!

Send an email back stating that they can only have back what you can afford to repay, and if they insist on taking you to court you will make sure the claim is defended and they will possibly be made to accept a £1 repayment.

Right, I hope I have read everything correctly. If I have then your defence is this....

 

You have no cotract with Wonga! You paid the loan back (twice), so that contract with them was satisfied in full.

 

They made an error by way of crediting your account with a duplicate amount. This is a simple overpayment, with no contract to enforce.

 

Naturally, you do owe them the money, and their only argument is that you should have noticed that it was extra money and shouldn't have spent it when it was not yours to spend. However, that is by the by.

 

They cannot charge their normal rate of interest on this debt. Any interest, if this went to court, would just be the statutory 8%, which in such a short space of time would be pennies.

 

Of course, you will have to pay anything charged by any debt collection agency in the way of fees, so get everything they want money for broken down and in writing and agree a payment plan.

 

---EXTRA BIT---

 

The Barker & Lowe letter looks like the standard letter a Wonga debtor would recieve. It would be worth a call to them to outline the situation and explain that you have no normal contractual agreement with them as that has already been satisfied. Then if you get nowhere, start it all in writing, stating your case.

Thanks for the help, I'm writing another letter to them today. I removed all of my details from it. I'll post the letter when it's done here and people can review it before I send it off.
